We represent no other interest group, & are all volunteers. At this point in time we have collected 19200+ signatures on our petitions from local citizens that object to this proposed project, 3 PrhnanLOii_iections LIFE SAFETY / TRAFFIC HAZARDS Traffic accidents can be deadly, especially when they occur at fast moving highway intersections. The traffic at Hwy 10 & Taylor Loop is already dangerous due to high traffic volume, speed of vehicles, & numerous access driveways onto Hwy 10 that are randomly spaced. Hwy 10 @ Taylor Loop is the most accident-prone intersection in Little Rock West of 1-430 according to Little Rock police reports; 81 accidents 2008- 2012, In 2013, 22 accidents were reported, (see "Seeing lied" article following) Murphy USA wants fueling pumps/nozzles for 22 24 vehicles ( more than any other station in Little Rock, except for the possibility of a freeway truck stop), as well as a quick -market of 3,445 s.f. on a lot that does not meet the minimum size required by city ordinances. A gas station/convenience mart has the highest vehicle movement count possible for a commercial property. This station could have 40 or more vehicles on the property at the same time. The Institute of Transportation Engineers (ITE) Publishes manuals for trip generation rates for estimating vehicle movements. A week day average for this type facility is 163 trips per nozzle per day (ref; Institute of Traffic Engineers ITE vol. 3 trip generation rates section 945). That means this station could average between 3,200 & 3,900 trips in & out per day added at this intersection from this development. That study average was based on stations that had 12 or 16 pumps, not 24. The quantity of quick in & out vehicle movements will be deadly at an already dangerous intersection! Left turns in from Hwy 10 West bound traffic would T,afficPatte,us create a serious accident risk, especially considering the volume generated by 22 — 24 fueling points. Left turns in would create added delays in the already crowded turn lane to Taylor Loop. Se ; The Taylor Loop driveway, w/ left turns out, is also dangerous. It has poor visibility of traffic coming 'i. over the hill on Taylor Loop & fast moving traffic i turning off of Hwy 10, The left turns out would conflict w/ left turns out of the existing driveway to Bank of the Ozarks to the West. r� Hwy 10/Cantrell Rd. —Early morning - Looking West. At 7:30 am cars in the tum lane back up to Pinnacle Valley Rd. Many early morning & afternoon drivers are inexperienced student drivers. Hwy 10 does not have any island/dividers to restrict left turns. This makes the unlimited turns across on coming traffic especially dangerous. The AR Hwy Dept. has plans to widen Hwy 10 & add medians to restrict left turns in the near future. The city should not allow even more of these dangerous turns across oncoming traffic in the interim period. This proposal was given a do not pass recommendation by the planning staff until there was a change regarding site turns. These site changes increased the density of the use (2-4 more pumps added) and turn restriction islands were added. As can be seen, this type of island has not worked. They are hit & broken by vehicles until they are gone. For islands to be safe & effective, they need to be painted traffic yellow w/ a yellow vertical at the corners so that separate opposing lanes & prevent left turns across oncoming traffic. That is the concept plan the Arkansas Highway Department has for this intersection when funds become available. Concrete turn diverter @ Mexico Chiquito 13924 Cantrell/Hwy 10 — Chipped face of curd, crack across island & cracks around in concrete. There are 6 gas stations East & West on Hwy 10, within a 5-1/2 mile stretch from Chenal to Pleasant Ridge Shopping Center (3 on each side of Hwy 10) w/ a total of 70 total pumps. The largest number of pumps at these is 16 pumps vs. the new Murphy proposal of 22 — 24 pumps. 3 of these stations have safe ingress & egress through controlled access drives etch ''' Murphy's @ Chenal Walmart 16 pumps Kroger's Candlewood 10 pumps Shell @ Pleasant Ridge 12 pumps Notice at these 3 stations there are no direct turns into the stations from the public roadway. These traffic movements are much safer. At the Planning Commission meeting 9/4/14, Murphy representatives presented a traffic engineer as a witness who said he had done a traffic study for this intersection for Murphy USA. Requests to see this study at the planning & traffic departments revealed that no one had even seen the study. Murphy has not replied to requests to see the study. This study needs to be in the public record & available to thepublic! INAPPROPRIATE HIGH INTENSITY BUSINESS TYPE This MEGA station, w/ extended hours of operation, would add a high number of traffic movements at an already dangerous intersection. A convenience mart/gas station with 22 —24 pumps/nozzles is not appropriate to be in close proximity to the numerous surrounding residential developments. It would also be in stark contrast to the existing business on the South side of Hwy 10. This corridor is the gateway to our neighborhoods, schools & homes. Bank of the Ozarks at the Southwest corner, across Taylor Loop from the proposed project is a good example of a project that respects the scale and character of the adjacent neighborhoods. The Hwy 10 Design Overlay District was created to prevent this size & look of this type of facility in this location. The Hwy 10 D.O.D. ; " The purpose of establishing this district is to protect & enhance the aesthetic & visual character of the lands surrounding Hwy 10." In particular; 1) "Protect & enhance the scenic quality of the Hwy 10 corridor by providing for sensitive developments which will maximize the naturals foliage & terrain, while also providing planted buffer & landscaped areas." 2) "To allow land use patterns compatible with present & future traffic capacity for Hwy 10." 3) "To create a distinctive parkway atmosphere along Hwy 10 by encouraging substantial building setbacks, extensive landscaping, & uniform tree plantings." EXCEPTIONS TO THE RULES The Planning Commission & Board of Directors have already rejected 3 of these Mega stations. 2 of those had 16 pumps, vs 22-24 pumps. This project is asking for special exceptions, or privilege to the rules that everyone is supposed to follow. The city has zoning ordinances, as well as a special Design Overlay District (D.O.D.) for the Hwy 10 corridor to control the physical & visual impact of new developments in the area as noted above. 1St 2 acre minimum parcel size required for any development. This condition has not been met. 2nd Rear yard setback to be a minimum of 40'. This condition has not been met. 25' is proposed — 38% less than the minimum required. 3rd East side yard setback to be a minimum of 30'. This condition has not been met. 25' proposed. 4th West side yard setback to be a minimum of 30". This condition has not been met. 25' proposed. 5th Vacuum unit freestanding kiosk located w/in the proposed 25' (exemption) side yard setback & visible from Taylor Loop. 6th Driveway set back from the Hwy 10 East side property line required to be 150' minimum. This condition has not been met. 50' proposed. 7th Driveway set back from the Taylor Loop South rear property line required to be 150' minimum. This condition has not been met. Approx. 60' proposed. 8th Drive-thru installations are required to have space for stacking of 3 vehicles. This condition has not been met. A 31 vehicle would likely block the entry drive at Taylor Loop. The small parcel size is the cause for needing all of the other exceptions. The developer is trying to "shoe horn" far too much onto an under size parcel. An installation w/ fueling points for 22 — 24 vehicles at a time is a MEGA gas station! This project is requesting 8 exceptions to the rules in order to be approved. No Mega station should be granted exceptions to the ordinances to shoe horn too much development onto a lot that is too small for the facility planned. Multi vehicle wreck, hwy 10 @ Taylor Lp. 9/27/14 CONCLUSION Multi vehicle wreck on Taylor Loop just before intersection w/ Hwy 10, 10/1/14 Our group has made multiple attempts to request a meeting w/ the Murphy representatives & their consultants to discuss potential modifications that could make the site safer (like their existing station at the Chenal Walmart 16 pumps w/ safe access) & more compatible w/ existing adjacent business on the South side of Hwy 10. They have chosen not to meet with us. This is objection is about public safety. Safety can't be dismissed. The overwhelming evidence is the intersection of Taylor Loop & Hwy 10/Cantrell Road currently has a serious safety problem. This development, because of the proposed use, drastically adds to that problem. The proposed use is a gas station which contains more pumps than any other station, not adjacent to an interstate, in Little Rock. The intense proposed use increases traffic movements and thereby exposes citizens to increased traffic safety risks. To vote in favor would ignore the public sentiment of the area and ignore how this use would only deepen an existing public safety problem. ( See enlarged plans following; ) Traffic. FILE NO.: Z -4386-B Portions of pages 14 & 15 Mr. Ernie Peters of Peters and Associates, the applicant's traffic engineer, addressed the Commission with clarification on a few items presented. He stated a traffic study was completed for the site. He stated the study was performed to determine the impact of this development on traffic in the area and to determine if limiting the access to the site would hinder the success of the commercial business. He stated there was little to no impact on traffic traveling by the site. He stated most of the traffic to the site was pass -by traffic. Mr. Peters stated sixty-two (62) percent of the traffic in the am and fifty-six (56) percent of the traffic in the pm peak was pass -by traffic. He stated this development added 77 -vehicles during the am peak and 119 -vehicles in the pm peak. He stated it was determined by the traffic study there would be no impact on the proposed development by limiting access to the site. He stated the drives were located 300 -feet from the intersection. He stated the center left turn lane on Taylor Loop Road was a "good" off -set and not a "bad" off -set. He stated based on the off -set there would not be turning conflicts as existed at Jerry Drive on Cantrell Road turning into the shopping center located on the north side of Cantrell Road. He stated AHTD had plans for improvements to the intersection of Cantrell and Taylor Loop Roads and the City was considering timing improvements to the signal which would improve operations at this intersection. REQUEST This is the traffic study that the Taylor Loop Safety Patrol has repeated requested to see & made a part of the public record. Based on information obtained from a traffic engineer at the Institute of Traffic Engineers, the data & conclusions of Mr. Peters do not look accurate. ( See added issue details following; ) Honorable Mark Stodola, Mayor City of Little Rock Board of Directors Re: Z -4386-B Murphy USA Fueling Station and Convenience Store Dear Mayor Stodola and Board of Directors, Residents of the neighborhoods in close proximity to the intersection of Cantrell Road and Taylor Loop Road who use this intersection routinely are strongly opposed to this development. The opposition centers around the facts that: (1) the safety of the citizens will be jeopardized by the traffic hazards the proposed development will create and exacerbate; and, (2) the inability of the applicant to comply with minimum requirements set out in existing laws including, but not limited to, the Highway 10 Scenic Corridor Design Overlay District. As a result, the proposed development is an inappropriate use for the location at issue. SAFETY Following is a list of problems that will be exacerbated or created by an approval of the referenced proposal: + Traffic at this intersection is already dangerous due to the high volume of traffic, the rate of speed at which the traffic is traveling and numerous access driveways on Cantrell Road that are randomly spaced and compete for the same center turn -lane. + A gas station/convenience mart has the highest vehicle movement count possible for a commercial property. This station could have 40 or more vehicles on the property at the same time. The number of quick in & out turning movements will be deadly at an already dangerous intersection! • According to a recent study published in the Arkansas Life (August 2014), the intersection of Cantrell Road and Taylor Loop Road is the most dangerous intersection West of I-430 and the 14th most dangerous in the city, accounting for 81 accidents between 2008 and 2012. [Copy enclosed for your reference]. According to Little Rock Police Department accident reports, 22 accidents occurred at or near this intersection in 2013. Within the past 10 days, there have been 4 or more accidents. This intersection is becoming increasingly dangerous without the added turn movements that would result from the approval of this development. • Planning Commission staff recommended denial of the application until changes were made to the site plan restricting 2 left turns. However, neither Planning Commission staff nor the Commissioners noticed that the applicant added 2 to 4 additional pumps (nozzles), for a total of 22-24 pumps. These additional pumps increase the density of the use and are counterproductive to the goal of making the site safer. The developer should not be permitted to develop according to the revised site plan in light of the fact that formal application was not revised. • The engineer's site plan proposes the use of triangular curb blocks to prevent 1 turn in & 1 turn out of the site. These curbs are not safe or effective. Curb blocks get battered & broken by vehicles until they are gone. Drivers routinely ignore the curb blocks because they are inconvenient and there is no reasonable way to enforce adherence in the absence of an accident. What does work are the raised medians currently proposed by the Arkansas Highway and Transportation Department to be installed on Cantrell Road. 411 • Allowing left turns out of the site onto Taylor Loop is also dangerous. This exit has poor visibility for traffic coming over the hill on Taylor Loop and fast moving traffic turning off of Cantrell. The view of drivers existing the establishment turning left on Taylor Loop would be blocked by vehicles stacked at the light waiting to cross or enter Cantrell. The left turns out would conflict with left turns out of the existing driveway for Bank of the Ozarks to the West. ■ The proposed use would increase the number of turns onto and off of both Cantrell and Taylor Loop, increasing the already present danger. The proposed use disregards the safety hazards which currently exist at the intersection and proposes to increase the hazard. • There are 6 gas stations on Cantrell within a 5-1/2 mile stretch from Chenal Parkway to Pleasant Ridge Shopping Center (3 on each side of Cantrell) w/ a total of 70 total pumps. The largest of these stations is Murphy's at Chenal Parkway and has 16 pumps. There are 3 Shell stations which are evenly dispersed which have 12 pumps each. The proposed Murphy station would have twice that number, meaning over 25% of the pumps would be found at 1 out of 7 gas stations within the 5-1/2 mile stretch. • According to the Institute of Transportation Engineers (ITE) studies concerning large gas stations with convenience stores, an average for this type of facility is 163 trips (vehicles) per nozzle per day. (According to Bill Henry, the City has the ITE publications which contain this data.) That means this station could average 3,200 to 3,900 trips (vehicles) per day. That study was based on stations that had 12 and 16 pumps, not 24. Even if you cut that number in half to be conservative and assume 1,600 trips (vehicles) per day, that means there are 3,200 turns in/out of the development for which the location has essentially 0 turning movements today. Approving the development will dramatically increase the traffic risk. The only way to safely deal with this is to require raised medians which have been proposed by the Arkansas Highway and Transportation Department and prohibiting all left turns. • During the Planning Commission meeting on September 4, 2014, the developer introduced the testimony of a traffic engineer, Ernie Peters, who stated that a traffic study had been completed for the site. It has been reported to opponents that the traffic study had not been provided to nor requested by planning staff or public works/traffic department prior to the Planning Commission hearing even though planning staff relied on statements from Mr. Peters attributable to the traffic study he testified had been conducted in changing its recommendation from denying the request to supporting it. Despite repeated requests to see the traffic study, a copy has not been forthcoming. ■ Notwithstanding the failure of the developer to produce the traffic study which was purportedly conducted for its benefit, the city should conduct a traffic study and/or require that the developer produce or commission such a study so that those city officials who are charged with planning for the future of this city are well informed on the impact that the approval of such a development will have on traffic at an already dangerous intersection. Statements of the developer or its representatives which are not supported by reports and underlying data should not be taken at face value, particularly under the circumstances. • It was suggested in relation to a companion application for a location at West 12th Street and University Avenue that a study should be conducted with respect to the impact of "MEGA" gas stations in light of the number of applications that the city has encountered recently. Unfortunately, there has been no further discussion of that. Conducting a study on the impact I of "MEGA" gast stations and convenience stores should be conducted prior to introducing these developments into areas that are surrounded by residential development. EXCEPTIONS TO THE RULES The applicant is requesting 8 different exceptions/variances to the existing zoning requirements and/or the Highway 10 Scenic Corridor Design Overlay District ("DOD"). The purpose of the DOD is to protect and enhance the aesthetic and visual character of the lands surrounding Hwy 10 by providing for sensitive developments, allowing land use patterns compatible with present and future traffic capacity for Hwy 10, and creating a distinctive parkway atmosphere along Highway 10 by encouraging substantial building setbacks, extensive landscaping, and uniform tree plantings. See LR Municipal Code § 36-343. While standing alone, some of the requested exceptions/variances may not appear to be of much significance, however, together they clearly evidence the fact that the site is simply too small for this development and its intense use and will only serve to benefit the developer and not the community and its citizens which the DOD was enacted to protect. According to LR Municipal Code § 36-348, property "which cannot be developed without violating the standards of this articles shall be reviewed through the planned unit development (PUD) section of the zoning ordinance, with the intent to devise a workable development plan which is consistent with the purpose and intent of the overlay standards. Little Rock Municipal Code § 36-451(c), related to PVDs, states: It is the intent of this article to assure that applications for PUD and PD are not granted for the sole benefit of the applicant, but are used to establish developments that: (I)Are compatible with the surrounding area; (2)Ire harmonious with the character of the neighborhood; (3)Do not have a negative effect upon the future development of the area; (4)Permit coordination of the planning of the land surrounding the PUD or PD; and (5)Create a desirable and stable environment. Following is a list of exceptions required for this development which are clearly not consistent with the purpose of the DOD nor do they comply with the express requirements for a PUD: 1. Lot size is less than 2 acres required by the DOD. Exceptions to existing law for lot size should be limited to less intense uses and only where a workable development plan can be devised which is consistent with the purpose and standards of the DOD. See LR Municipal Code §§ 36- 346(a)and 36-348. Infill development does not necessarily mean that such lots will or have to be less than 2 acres nor should the fact that approval of other developments on less than 2 acres dictate approval for this development. Each application should stand on its on and, considering the high intense use of the applicant, a lot that is less than the required minimum 2 acres is not sufficient, will only increase the density of development contrary to the DOD, and should not be approved. 2. Building on the Southern perimeter encroaches into the 40ft rear yard building setback required by the DOD. As noted by planning staff, the rear of the building is actually 25 feet from the Southern perimeter which is border by property zoned R-2 and includes a residential structure that is occupied. See LR Municipal Code § 36-346(c). 3. ATM and drive encroach into the 40ft rear yard building setback required by the DOD. As noted by planning staff, the rear of the building is actually 25 feet from the Southern perimeter which is border by property zoned R-2 and includes a residential structure that is occupied. See LR Municipal Code § 36-346(c). It should also be noted that drive-thru installations are required to have im sufficient space for the stacking of 3 cars. A 3rd car at the ATM will block the entry drive at Taylor Loop. Public Works staff recommended that the ATM be relocated to prevent the drive from being blocked, but the Planning Commission approved of the revised site plan on which the ATM remains in the same location. 4. Fuel canopy along Cantrell encroaches into the 100 ft building setback required by the DOD. See LR Municipal Code § 36-346(b). 5. Vacuum unit abutting Taylor Loop encroaches into the 30 ft building setback line on the West side of the property. See LR Municipal Code § 36-346(d). 6. Proposed signage on the North and South facade is twice the amount allowed by the DOD. The plans call for 20% when only 10% is allowed by the DOD. See LR Municipal Code §§ 36-343(6) and 7. Driveway spacing on Cantrell. The driveway set back from the East property line is proposed to be 50 ft when 150 ft is required. That's a setback of 33% of what is required. The driveway set back from the intersection is proposed to be 240 ft from the intersection when 300 ft is required. See LR Municipal Code § 31-210(e) 8. Driveway spacing on Taylor Loop. The driveway set back from the East property line is proposed to be 60 ft when 150 ft is required. That's a setback of 40% of what is required. The driveway set back from the intersection is proposed to be 180 ft from the intersection when 300 ft is required. See LR Municipal Code § 31-210(e). It should be noted that the property adjacent to the proposed development to the South is zoned R-2 residential and is improved with a house that is occupied. As to exceptions/variations 7 and 8 with respect to the driveway spacing from the intersection, Planning staff originally noted properly that LR Municipal Code §§30-43 and 31-210 require that driveways be spaced at least 300 ft from other driveways, streets and intersections and 150 feet from side property lines. "The purpose of these standards is to provide for the safe and efficient movement of vehicles to, from and within sites developed or modified for use by significant numbers of vehicles. These standards provide for proper turning movement, lane width, spacing and relationships between on street movement and within a development site. The standards are intended to be compatible with developed areas and urbanizing segments of the community." See LR Municipal Code § 31-210. Planning staff subsequently changed its position stating that the DOD has a lesser requirement which would control. What planning staff didn't address is LR Municipal Code § 36-5 which states "Where the provisions of this chapter impose greater restrictions than those of any other ordinance or regulation, the provisions of this chapter shall prevail. Where the provisions of any other ordinance or local regulation impose greater restrictions than those of this chapter, the provision of such other ordinance or local regulation shall prevail." Logic should dictate, particularly when dealing with driveway setback requirements for an already dangerous intersections, that the more stringent requirements should control as clearly set out in the general access and circulation requirements of the LR Municipal Code. Allowing this development to have driveways, through which there will be many cars turning in and out each hour, closer than 300 ft from the intersection is not safe and should not be allowed. The proposed development would create numerous new traffic movements at an already dangerous intersection which are not compatible with present of future traffic at this intersection. Additionally, the proposed developments driveways and improvements encroach into the required setbacks on all sides. The proposed development would also be in stark contrast to the existing business on the South side of Hwy 10. This corridor is the gateway to many neighborhoods, schools & homes. Bank of the Ozarks at the Southwest corner, across Taylor Loop from the proposed project is a good example of a project that respects the scale and character of the adjacent neighborhoods. In other words, the proposed development is simply inappropriate for this location. CONCLUSION The safety of Little Rock's citizens cannot be dismissed. The overwhelming evidence shows that Taylor Loop & Hwy 10 is already a dangerous intersection. This proposed development, because of the nature of the use and the number of turning movements it will create, will drastically increase the danger at this intersection. The increased traffic movements/turns exposes citizens to increased traffic dangers. To vote in favor would ignore the public sentiment of the area and ignore how this use would only increase and enhance an existing public safety problem. Murphy has offered no case for the zoning and DOD exceptions/variances except its own profits. This proposed development will not increase economic development and city tax revenues, despite assertions by the developer to the contrary, as it will only take business from its smaller competitors. A new gas station will not increase the demand for gas or make their drivers buy more snack foods. Approving this development only changes the supply side of the equation, not the demand side and, therefore, there will be no increased tax revenue. There are already 6 gas stations with convenience stores on Hwy 10 from I-430 to Chenal Parkway already. Simply put, this proposed development is not needed. Approval of this development will bring no benefit, only harm, to the surrounding neighborhoods. As you can see, the opposition is primarily focused on the traffic safety hazards that this development will create and/or increase. It should be noted that there is also concern in how the proposed use will negatively affect nearby residential property values and increase the propensity for crime in the area in light of such developments being frequent targets for criminals. It will spur no future development. A companion application of the developer for 24 pump station and convenience store to be located at the Northwest corner of West 12th Street and University Avenue actually requested a lesser zoning designation than its current I-2, light industrial, designation. Jerry Drive and Shepard Drive are residential streets, not arterial streets. 6. The Secluded Hills neighborhood will be an ideal location for a criminal to quickly flee the scene. I can hardly leave my Westchester neighborhood with traffic following this pathway "racing" up the hill of Taylor Loop headed to Rahling. I have lived in Westchester for 18 years and use the interchange in question each day. Many cars are speeding (45-65mph) on Hwy. 10 and run yellow lights there that have caused many accidents. It would be interesting to see police reports for that intersection. The left turn lane on Cantrell Westbound regularly has 6-10 cars lined up to enter Taylor Loop. East bound Hwy. l Or's stop one lane of traffic to enter north side shopping at Fuller Hardware, other services, and eating at Pizza Cafe West or picking -up at Pizza Hut --IT'S A REAL MESS MANY TIMES A DAY! In recent years another strip center has been added with Senior Tequilla and 10 Fitness. I can imagine, with experience, the danger and confusion of a Murphy Oil Station there on the south side. I am very familiar with the Murphy Fuel Station operation in Fayetteville--Wedington Road. It too is on a very crowded street next to a IHOP and lots of restaurants, grocery stores and other commerce. The road has 4 lanes with a 5th "turn" lane in the middle. Ms. James, we own and have resided in Secluded Hills subdivision for the past 20 years. During that time, as you probably know, Cantrell Road west of Rodney Parham has undergone numerous changes and development. In my opinion, there seems to have been very little planning involved in the changes that this artery has seen. I'm sure you've heard the complaints of residents about the congestion between Pleasant Ridge and 1430. Further west, the strip of businesses between Kroger and Taylor Loop have created, quite frankly, a nightmare for the folks that live in this area, for the folks that frequent those businesses, and even for the residents that must pass through to get to the Chenal neighborhoods. The middle turn lane would be a wonderful feature if the drives on opposite sides of Cantrell lined up with one another. They don't. Frequently, cars approach each other head-on in an attempt to turn north from the east -bound side, or vise -versa. The newer businesses that were built should have been "encouraged" to build their drives to alleviate traffic entanglements, but it appears they did exactly the opposite. They are offset, and not in the right direction. Additionally, the businesses in the strip center where the hardware store sits are difficult to get to from the east -bound side because the turning lane is often tied up with traffic wanting to turn south onto Taylor Loop road. And now you're proposing to exacerbate the problem with yet another business on the southeast corner? The prospect of even more traffic attempting to turn left from either Cantrell or Taylor Loop into a gas station/convenience store is mind-boggling. Incidentally, if you want to alleviate traffic along this stretch, we should build a road connecting Taylor Loop north of Cantrell to Pinnacle Valley Road, and make it accessible from the strip mall containing the hardware store. This would take enormous pressure off of the middle turning lane between these two streets. I stand decidedly against the proposal to build this gas station on that corner. There are ample places along Cantrell road that would be a better home for such a business, the least of which are some of the eyesores and useless edifices (Josephine Pankey Education Center) along Cantrell road just east of Kroger or west of Wahlgreens. Currently there is a moribund bank (ATM only) and some "legacy" structures at that location. After attending an informal meeting with MurphyUSA and their real estate and engineering contractors, it is clear that they would be good corporate neighbors. The engineering, by White- Daters, seems well thought out. The overall lay -out very nearly meets the recommendations found in the overlay from the 1990s, which can't be said of many newer developments along this "scenic corridor." While none of us pine for a gas station as a near -neighbor, we are no better than anybody else and wanting these businesses "over there" smacks of elitism. Given the above, it is unfortunate that I must object to any commercial development at that particular intersection that relies on high traffic volume; gas station, fast food restaurant, etc. The proposed direct access to Cantrell road is mirrored by only one other new (relatively) development, a bank across Taylor Loop at the SW corner of the intersection. Banks have much, much less traffic. There are already several dangerous traffic conflicts in that immediate area (details can be provided), and adding several hundred additional traffic actions, per day, near that intersection is a recipe for disaster. Just look to our neighboring states out West. Fire is nothing to be played with!! Last, but not least, the last thing that we need in our neighborhood is a gas station, bank, or a church. Even when the traffic light at Cantrell/Taylor Loop is green for Taylor Loop, there are many cars turning from eastbound Cantrell traffic. If there were turning cars into the proposed service station, it would be impossible for westbound Cantrell traffic to turn south onto Taylor Loop. This is a bad proposal for SAFETY reasons plus the degradation of the neighborhood's property values. I am concerned about traffic, safety, and how it may affect property values. We already have a lot of traffic issues and potential for vehicle accidents between the 10 Fitness shopping center and the Taylor Loop/Cantrell intersection. Adding another high traffic business would increase the risk of accidents at the Taylor Loop/Cantrell intersection. The neighborhood safety would also be placed in jeopardy. Shepard Street then onto Hinson Road would allow the perfect escape route for criminals along with placing the safety of the members of the neighborhood at risk and setting them up for a potential target. I hope that you will reevaluate the decision to open the store at this location. There are other 24 hour convenience stores located nearby so I do NOT think this is needed. It is also not close to the freeway so why would we need such a large gas station or convenience store when there are many other options available along Cantrell Road. The safety of our community is more important. Perhaps that space would be better used for a neighborhood pool or anything other than something that would increase the crime and traffic rates. Every day, but especially between the hours of 4:30 p.m. and 6:30 p.m., it is nearly impossible to get into or out of the shopping area for Pizza Cafe and Fuller Hardware. This causes the whole area to be affected, which includes the oddly constructed pseudo -intersection at Jerry and Cantrell just a few feet east. It is a source for great congestion and potential accidents on a daily basis. We have always have felt errors were made when they set the entrances for the shopping/restaurant (UPS, Senor Tequila) areas across from Jerry. Getting onto Jerry from Cantrell or from Jerry to Cantrell in either direction and/or across to the shopping/restaurant area is a challenge daily as the corridor has become quite busy, especially during the work/commuting hours in the morning and afternoons. We simply feel that the site is inappropriate for businesses that rely on high traffic volume (gas stations, fast food, etc). We do realized that inevitably something will replace the bank in that area, but feel it need not be an enterprise that will add hundreds of traffic events per day to that area. I take Cantrell Road all the way home every evening because I-630 is usually gridlocked. Cantrell/Highway 10 used to be a pleasant drive, even beautiful. I used to consider it the only decent entry into the city. That has been destroyed. Housing developments are being allowed to add density, with no thought to the impact on the roads and the environment. But that rant is for another day.... Has anybody on the Planning Commission traveled Cantrell Road on a regular basis - during rush hour? The lanes at Taylor Loop are narrow - and the vehicles are big. The suicide lanes are packed with drivers from both directions, sometimes with disasterous results (collisions happen regularly). There are too many businesses there already... every day at least one driver pulls out in front of me to get to the lanes going in the opposite direction. Or they pull on to the main road and zip across in front of me because they need to make an immediate left turn. Can't you please slow the growth on Highway 10 just a little? At least until you guys can figure out a way for it to not be so crazy out there? Do we really, really need a gas station right in the middle of a traffic situation that is already a nightmare? I've study that, given it a lot of thought and have discussed it with several in my neighborhood since receiving it. Knowing that y'all will soon develop and issue another Staff Recommendation regarding this revised proposal, I am writing you here to ask you to recommend denial of the request again. I continue to oppose this proposal for these reasons: First and foremost, this development will create a huge public safety issue. Even with the reduction in the number of related left turns, a gas station and convenience store of this magnitude will exacerbate what is already a challenging and accident -prone intersection. The large volume of traffic currently flowing through that intersections includes many parents and children going to and from the many schools in the area. This includes four high schools with their inexperienced, young drivers. I trust y'all saw the Arkansas Life article, in their August issue, which ranks this intersection as the 14th most accident-prone in our City, based on five years of data from the Little Rock Police Department. The developer's plan of a gas station and convenience store with double the number of gas pumps than most currently in the area, on such a small lot, so near a high volume intersection is a recipe for a recurring public safety hazard. Additionally, this revision still will require several variances from the Highway 10 Scenic Corridor Design Overlay District (DOD), including: A. the development being too large for the 1.8 acres (2 acres are required per the DOD), B. building signage (building signage is twice what the DOD allows), C. rear setback being requested is too small (Murphy is asking for 25 feet when the DOD requires 40), D. driveway spacing does not comply, E. signage proposed covers 20% of the buildings when the DOD allows a maximum of 10%. The Highway 10 Scenic Corridor Design Overlay District is continually being whittled away. We need to stop the degrading of what is a very wise plan. Further, a gas station and convenience store are among the lowest forms of commercial development and, therefore, is likely to become an eyesore, if not an attraction to the criminal element of our society. While Murphy's latest concession is to reduce the operating hours of this location to 5am - Midnight, the same risk and degradation of the area exists. I understand this lot will go commercial soon. A more welcomed commercial development would be one with less intensity (i.e., lower traffic in and out, fewer operating hours). Please recommend denial of this request. Thank you. Perhaps it's newest ranking as the 14th most dangerous intersection will also help with the realization that this is a very bad plan. Additionally, has it been taken into consideration that LRSD has purchased 40 acres two traffic lights away from this intersection for a middle & high school? This will mean even more traffic passing through this intersection for 10 months of the year. No one who has ever tried to turn left at this intersection, or even travel through it, would take this proposition serious. I live two blocks from the intersection. It is very difficult already to cross Cantrell and almost impossible at times to turn west from the fuller and sons hardware shopping center. In particular, any vehicle trying to leave this proposed development by turning left onto either Cantrell Road or onto Taylor Loop would be hazardous at best. I am requesting that unless the development can restrict all traffic entering and exiting this property to right turn only, that you vote against this development. This intersection is a high traffic area. The traffic trying to turn in the Pizza Cafe/ Hardware Store versus the traffic trying to turn on Taylor Loop is always a cluster. There are frequent wrecks at this intersection due to the small area where cars are trying to turn both ways. A gas station at this intersection would only make matters worse. It would be most helpful if the far end of the parking lot, that Pizza Cafe and the other stores share, extended into a road/outlet that went behind Buffalo Wild Wings. This way, traffic could turn at the stop light at Cantrell and Taylor Loop. Thanks! They are moving BACK to mid -town. We are RUINING west Little Rock. If this over building continues, the beauty and tranquility that made WLR what it was will no longer be!
