The site being considered for rezoning is the former
location of an auto dealership and the proposal is to
utilize the property for an auto dealership again. The
previous dealership was American Motors Corporation,
who still owns the property, and it is the staff's
understanding that American Motors plans to reopen the
facility. The use is compatible with the area and the
1-30 frontage which has a used car lot to the east and
a new car dealership to the west. The existing land
use and zoning patterns are similar with a mix of uses
and "R-2," "C-3,11 "C-4" and „I"L" zoning districts.
The property has been vacant for longer than one year.
The site is heavily paved with two structures on it.
There are no unique physical characteristics associated
with the property.
There are no right-of-way requirements or Master Street
Plan issues.

4. Because of the existing flooding in the McDaniel Drive
area, Engineering has recommended an internal drainage
plan and detention. No other adverse comments have
been received from the reviewing agencies as of this
writing.
5. There are no legal issues.
6. The property was annexed into the City in 1979 and has
been used for a number of years as an auto dealership.
There is no documented neighborhood position on the
site.
7. The Suburban Development Plan identifies the location
for some commercial and light industrial uses. With
the existing development pattern, an auto dealership is
compatible with the area and staff supports the "C-4"
request. A "C-4" reclassification appears to be the
most appropriate district for the property. There is
one issue that should be addressed and that is the Bill
of Assurance. A portion of the property being
considered for rezoning is covered by the Bill of
Assurance for Town and Country Estates. It restricts
two tracts with I-30 frontage for commercial purposes
and "all other lots shall be used for single family
residential purposes only." This rezoning request
includes Lot 89, which is one of the residential lots
and should be excluded from the rezoning to "C-4."
There are no other significant issues.
STAFF RECOMMENDATION:
Staff recommends approval of the "C-4" request with the
exception of Lot 89, Town and Country Estates. That parcel
should be left "R-2."
PLANNING COMMISSION ACTION:
The applicant, Phillip Carroll, was present. There were no
objectors. Mr. Carroll stated that the American Motors
Corporation had no objection with eliminating Lot 89, Town
and Country Estates, from the application. He then amended
the request to exclude Lot 89. The Planning Commission
voted to recommend approval of the rezoning request as
amended. The vote: 10 ayes, 0 noes and 1 absent.
