6 PURPOSES.

8 WHEREAS, Ordinance No. 19,507 was passed on March 21, 2006, establishing a PZD, Planned
9 Zoning District, titled the Ranch Tract D Short -Form PCD; and,
10 WHEREAS, the shopping center approved for the Ranch Tract D Short -Form PCD is no longer a
11 viable project and the owner of the subject property has requested the repeal of the PZD ordinance and
12 restoration of the zoning classification as previously existed; and,
13 WHEREAS, the Little Rock Planning Commission reviewed the request for revocation for the Ranch
14 Tract D Short -Form PCD at their January 7, 2016, public hearing and voted 10 ayes, 0 nays and 1 absent
15 to forward the revocation request to the Little Rock Board of Directors for final action.
16 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS.
18 SECTION 1. That Ordinance No. 19,507 is hereby repealed, removing from the Official Zoning Map
19 the classification of PCD.
20 SECTION 2. That'the underlying C-3, General Commercial District, zoning classification is restored
21 to the property described as: The Ranch Lot 3 Tract D, Little Rock, Pulaski County, Arkansas.
22 SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
23 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
24 necessary to affect and designate the change provided for in Sections I and 2 hereof.
25 SECTION 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
26 or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
29 ordinance.
30 SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
31 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

The request is a revocation of the existing Planned
Commercial District zoning and the restoration of the
underlying C-3, General Commercial District zoning.

Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval
of the PCD zoning by a vote of 10 ayes, 0 noes and
1 absent.
The Planning Commission reviewed the proposed PCD
request at its January 7, 2016, meeting and there were no
registered objectors present. All property owners located
within 200 -feet of the site along with the Chevaux Court
Property Owners Association were notified of the Public
Hearing.
BACKGROUNDI Ordinance No. 19,507 adopted by the Little Rock Board of
Directors on March 21, 2006, rezoned the site from C-3,
General Commercial District to PCD. The request was to
allow the future development of the site with a building not
to exceed 10,000 square feet and 74 parking spaces. The
approval allowed the end user to be a restaurant use. If the
use was a restaurant use the maximum building square
footage would be 7,300 square feet. This development did
not occur. The PCD zoning has expired.
Per Section 36-454(d) The owner of an approved PD or
PUD may, for cause, request repeal of the ordinance
establishing the development when it has been determined
that the development will not occur. A written request may
be filed with the City staff at any time up to three (3) years
after the date of adoption of the ordinance creating the
PUD or PD. The request shall set forth the cause of the
repeal.
According to the ordinance, the Planning Commission
recommendation on the repeal request shall be forwarded
to the Board of Directors for their consideration. The board
of directors may grant or deny the request or return the
request to the planning commission for further study. If the
request is approved, an ordinance shall be adopted
repealing the PUD or PD.
The owner has stated the development will not occur as
planned. The owner is requesting the PCD zoning be
revoked and the C-3, General Commercial Zoning District
zoning be restored.

Pursuant to our telephone conversation yesterday, please accept this email as the owners',
FCC Tract D Partnership, request to revoke the
2006 approved PCD zoning classification and return it to its previous C-3 Commercial
classification.
Please advise if there is any other information that you need from me.
As I understand this item will be heard at the January Planning Commission meeting.
Can you provide me the Planning Commission and BOD calendars for the rest of 2015 and all
of 2016.
