HomeMy WebLinkAbout22224 1 ORDINANCE NO. 22,224 2 3 A ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE 4 TO BID; TO AUTHORIZE THE CITY MANAGER TO EXECUTE A 5 CONTRACT WITH SAFETYCOM, FOR THE TOTAL AMOUNT OF ONE 6 HUNDRED FIVE THOUSAND, FOUR HUNDRED FIFTY TWO AND 7 71/100 DOLLARS ($105,452.71), PLUS APPLICABLE TAXES AND FEES, 8 FOR THE PURCHASE OF ONE (1) ANNUAL OUTDOOR WARNING 9 SIREN SYSTEM; AND FOR OTHER PURPOSES. 10 11 WHEREAS,the Emergency Management Division is committed to providing for the maintenance and 12 operation of the Little Rock Outdoor Warning Siren System throughout the City; and, 13 WHEREAS, to accomplish this goal, the Division proposes the purchase of one (1) Annual 14 Maintenance Agreement, a Back-Up Siren Activation Point, and various parts for overall maintenance of 15 the siren system;and, 16 WHEREAS, in 2004, Safetycom was the lowest/most responsible bidder for Solicitation No. 03287 17 and is the original manufacturer, builder and sole provider of the Outdoor Warning Siren System with on- 18 call repair and service of the Outdoor Warning Sirens since the initial award; and, 19 WHEREAS,the amount of the contract is One Hundred Five Thousand,Four Hundred Fifty-Two and 20 71/100 Dollars($105,452.71), plus applicable taxes and fees, with funding available from the Emergency 21 Management General Budget,Account No. 101007-63390. 22 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK,ARKANSAS: 24 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a sole-source 25 contract with Safetycom for the purchase of one(1)Annual Outdoor Warning Siren System Maintenance 26 Agreement and Equipment Upgrades for a total cost not to exceed One Hundred Five Thousand, Four 27 Hundred Fifty-Two and 71/100 Dollars($105,452.71),plus applicable taxes and fees. 28 Section 2. Funds for this purchase are available from the Emergency Management General Budget, 29 Account No. 101007-63390. 30 Section 3. Because Safetycom is the original manufacturer and builder of the Outdoor Warning Siren 31 System with on-call repair of the outdoor warning sirens since the initial award and is the sole provider of 32 this service, the Board of Directors declares it is impractical and unfeasible to submit this purchase to 33 competitive bids. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 5 ordinance. 6 Section 5. Repealer.
