HomeMy WebLinkAbout15912 1 RESOLUTION NO. 15,912 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO 4 EXECUTE AN AMENDMENT TO THE CONSTRUCTION 5 MANAGEMENT SERVICES AGREEMENT WITH BALDWIN & SHELL 6 CONSTRUCTION COMPANY, IN THE AMOUNT OF TWO HUNDRED 7 SEVENTY-FIVE THOUSAND, ONE HUNDRED EIGHTY-THREE 8 DOLLARS ($275,183.00), FOR THE LITTLE ROCK POLICE 9 DEPARTMENT HEADQUARTERS PROJECT; AND FOR OTHER 10 PURPOSES. 11 12 WHEREAS, the City's Request for Qualifications, Event No. 361 ("RFQ") was issued for the 13 selection of a Construction Manager to provide Design Assistance, Pre-Construction, General Contractor, 14 and Complete Construction Management Services for the City of Little Rock's Little Rock Police 15 Department Headquarters Project(the"Project"); and, 16 WHEREAS, pursuant to this RFQ, the Selection Review Committee selected Baldwin & Shell 17 Construction Company ("Baldwin & Shell") from the candidates submitting proposals, and a 18 recommendation to select Baldwin & Shell for this project was submitted to the City Manager for 19 approval; and, 20 WHEREAS, Baldwin & Shell has the required professional skill and judgment, and is willing to 21 work with the City and the City's architect in a relationship of trust and cooperation, to ensure that the 22 renovation of the McFadden Building to house the Little Rock Police Department Headquarters is 23 completed within budget, within schedule and in accordance with Arkansas State Law and the City's 24 construction Contract Documents; and, 25 WHEREAS, on January 7, 2020, the City Board of Directors adopted Resolution No. 15,143, to 26 authorize the City Manager to enter into a Construction Management Services Agreement with Baldwin 27 & Shell for Pre-Construction Services regarding the Project in an amount not to exceed Twenty 28 Thousand,Four Hundred Fifty-Eight Dollars($20,458.00);and, 29 WHEREAS, on March 3, 2020, the City Board of Directors adopted Resolution No. 15,182, to 30 authorize the City Manager to enter into an Agreement with Baldwin & Shell for Demolition Services 31 regarding the Project in an amount not to exceed One Hundred Four Thousand, One Hundred Fifty-One 32 Dollars($104,151.00); and, 33 WHEREAS, on March 9, 2020, a Construction Management Services Agreement ("Agreement") 34 was executed by the parties for Pre-Construction and Demolition Services regarding the Project in an [Page 1 of 2] 1 amount not to exceed One Hundred Twenty-Four Thousand, Six Hundred Nine Dollars ($124,609.00); 2 and, 3 WHEREAS, on December 15, 2020, the City Board of Directors adopted Resolution No. 15,370, to 4 approve the final Guaranteed Maximum Price for the project in the amount of Six Million,Eight Hundred 5 Eighty-Six Thousand,Two Hundred Ninety-One Dollars($6,886,291.00);and, 6 WHEREAS, an amendment to the Construction Management Services Agreement, in the amount of 7 Two Hundred Seventy-Five Thousand, One Hundred Eighty-Three Dollars ($275,183.00), is necessary 8 due to the addition of safety mechanisms and supply chain increases and delays due to the COVID-19 9 Pandemic. 10 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 11 OF LITTLE ROCK,ARKANSAS: 12 Section 1. The Board of Directors hereby authorizes the City Manager to execute an amendment to 13 the current Construction Management Services Agreement with Baldwin & Shell Construction Company, 14 in the amount of Two Hundred Seventy-Five Thousand, One Hundred Eighty-Three Dollars 15 ($275,183.00),for the Little Rock Police Department Headquarters Renovation Project. 16 Section 2. Funding will be available from the 2022 Budget Adjustment that will be approved at the 17 March 7, 2023, Little Rock City Board of Directors Meeting. 18 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 19 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 20 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 21 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 22 resolution. 23 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, including Little Rock, 24 Ark., Resolution No. 15,098 (November 5, 2019), Little Rock, Ark., Resolution No. 15,143 (January 7, 25 2020), and Little Rock, Ark., Resolution No. 15,182 (March 3, 2020) and Little Rock, Ark., Resolution 26 No. 15,370 (December 15, 2020), that are inconsistent with the provisions of this resolution, are hereby 27 repealed to the extent of such inconsistency. 28 ADOPTED: February 21,2023 29 • APPROVED: 30 31 I/JwfirQ, 32 :fir—► ,City Clerk Frank Scott,Jr.,Mayor 33 AP ' I AS TO LEGAL FORM: 34 35 / 144'1'4 A 36 Thomas M.
