3 A RESOLUTION TO EXTEND THE HEIGHTS TEMPORARY
4 ENTERTAINMENT DISTRICT, FOR FIVE (5) DAYS ON FEBRUARY 25,
5 2023,MARCH 16,2023, APRIL 1,2023,APRIL 20,2023 AND MAY 5, 2023;
6 AND FOR OTHER PURPOSES.

8 WHEREAS, on July 23, 2019, the Board of Directors of the City of Little Rock, Arkansas, passed
9 Little Rock, Ark., Ordinance No. 21,761 as amended which permitted the creation of a Temporary
10 Entertainment District pursuant to Arkansas State Law and City Ordinance; and,
11 WHEREAS, the City Board of Directors determined the creation of a Temporary Entertainment
12 District as proposed by Ordinance No. 21,761 as amended is appropriate as recommended by the Planning
13 &Development Department; and,
14 WHEREAS,the City Board of Directors adopted in Resolution No. 15,529(September 7,2021),the
15 Heights Entertainment District as a Temporary Entertainment District providing the days and hours of
16 operation to be September 16,2021,October 21,2021 and November 18,2021,from 4:00 PM to 9:00 PM;
17 and,
18 WHEREAS,the City Board of Directors adopted in Resolution No. 15,647(April 5,2022),the Heights
19 Entertainment District as a Temporary Entertainment District providing the days and hours of operation to
20 be April 21,2022,from 4:30 PM until 9:30 PM;April 22,2022,from 4:30 PM until 9:30 PM;May 5,2022,
21 from 4:30 PM until 9:30 PM; May 19, 2022, from 4:30 PM until 9:30 PM; June 16, 2022, from 4:30 PM
22 until 9:30 PM; and from July 21,2022,from 4:30 PM until 9:30 PM;and,
23 WHEREAS, the City Board of Directors adopted in Resolution No. 15,802 (October 3, 2022), the
24 Heights Entertainment District as a Temporary Entertainment District providing the days and hours of
25 operation to be on to begin on October 20, 2022, and end January 19, 2023, providing days and hours of
26 operation to be October 20,2022,from 5:00 PM until 9:00 PM;October 23,2022,from 1:00 PM until 9:00
27 PM; October 29, 2022, from 10:00 AM until 9:00 PM, and January 19, 2023, from 5:00 PM until 9:00
28 PM; and,
29 WHEREAS, the City of Little Rock has received an application to extend the Temporary
30 Entertainment District to begin on February 25, 2023, and end on May 5, 2023, providing days and hours
31 of operation to be February 25,2023,9:00 AM-8:00 PM; ,March 16,2023,4:00 PM-9:00 PM;April 1,
32 2023,9:00 AM-8:00 PM; April 20,2023,4:00 PM-9:00 PM;and May 5, 2023,3:00 PM- 10:00 PM.
33 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
34 OF LITTLE ROCK,ARKANSAS.

1 Section 1. The Heights Entertainment District is hereby created by the City of Little Rock as a
2 Temporary Entertainment District on February 21,203, and subject to Ordinance No. 21,761, as amended
3 and its defined terms.
4 Section 2. Boundaries. The temporary boundaries of the Heights Entertainment District are the
5 District that includes the location of the Temporary Entertainment District runs along Kavanaugh Boulevard
6 from University Avenue in the west to North Polk Street in the east. In addition, the District includes
7 Kavanaugh Boulevard from Cantrell Road running north along the eastern side of Kavanaugh Boulevard
8 to the intersection of Club Road and North Van Buren Street. Finally,the District includes the area zoned
9 for business immediately north of the intersection of Club Road and North Van Buren Street.
10 Section 3. Timeframe. The Heights Temporary Entertainment District will be designated as a
11 Temporary Entertainment District upon the adoption of this resolution and shall expire on May 5, 2023.
12 The dates and times are February 25, 2023, 9:00 AM — 8:00 PM; March 16, 2023, 4:00 PM— 9:00 PM;
13 April 1,2023,9:00 AM—8:00 PM;April 20,2023,4:00 PM—9:00 PM;and May 5,2023,3:00 PM—10:00
14 PM. The City reserves the right to amend boundaries and hours of operation at its sole discretion.
15 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
16 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
17 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
18 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
19 resolution.
20 Section 5. Repealer. All laws, ordinances, resolutions,or parts of the same,that are inconsistent with
21 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
