3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO. 12,270 (MAY 2,
4 2006) TO REFLECT THE CORRECT PURCHASE PRICE OF ONE (1) HIGH -SIDE DUMP
5 MECHANICAL STREET SWEEPER FROM TENANT SALES AND SERVICE FOR THE PUB -
6 LIC WORKS DEPARTMENT; AND FOR OTHER PURPOSES.

8 WHEREAS, the Fleet Service Department needed a high -side dump mechanical street
9 sweeper for the Public Works Department, and after utilizing a state contract with the Texas
10 Multiple Award Schedule State Contract purchased one pursuant to Little Rock, Ark., Resolution
11 No. 12,270 (May 2, 2006); and
12 WHEREAS, the reported purchase price of One Hundred Fifty Thousand, Nine Hundred Fifty
13 and 11 /100 Dollars ($150,950.1 1) was calculated by the Department of Fleet Services to be the
14 amount needed after the further reduction of the City trade -in, but in fact the quoted price
15 from the state contract had already included the trade -in value of City equipment, so the cor-
16 rect cost is One Hundred Sixty Four Thousand Six Hundred and Fifty Dollars and Eleven Cents
17 ($160,650.11);
18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
19 ROCK, ARKANSAS:
20 Section 1. Section 1 of Little Rock, Ark., Resolution No. 12,270 (May 2, 2006) is hereby
21 amended to read as follows:
22 The Board of Directors hereby authorizes the City Manager to enter into a contract
23 with Tennant Sales and Service Company, through the Texas Multiple Award Schedule
24 State Contract, for the purchase of one (1) high -side dump mechanical street
25 sweeper, in the amount of One Hundred Sixty -Four Thousand Six Hundred and Fifty
26 Dollars and Eleven Cents ($164,650.11).
27 Section 2. Severabi/ity. In the event any title, section
paragraph, item, sentence,
28 clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconsti-

I tutional, such declaration or adjudication shall not affect the remaining portions of the
2 resolution which shall remain in full force and effect as if the portion so declared or ad-
3 judged invalid or unconstitutional was not originally a part of the resolution.
4 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are incon-
5 sistent with the provisions of this resolution, are hereby repealed to the extent of such incon-
6 sistency including, but not limited to, Section 1 of Little Rock, Ark., Resolution No. 12,270 (May
7 2, 2006).
