Provide design of street conforming to "MSP" (Master Street Plan). Construct one-half street improvement to these streets including 5-foot sidewalks with planned development. 3. Plans of all work in right-of-way shall be submitted for approval prior to start of work. 4. Stormwater detention ordinance applies to this property. PUBLIC TRANSPORTATION ELEMENT A CATA bus route is located one block south of this site, along Kanis Road. July 6, 2000 ITEM NO.: 1 (Cont.) PUBLIC NOTIFICATION FILE NO.: Z-4328-A All owners of property located within 200 feet of the site, all residents within 300 feet and the John Barrow and Brownwood Terrace Neighborhood Associations were notified of the rezoning request. LAND USE PLAN ELEMENT Planning Division: The request is located in the Boyle Park Planning District. The Land Use Plan shows Low Density Residential for this location. The property is currently zoned MF-12 Multifamily and the zoning request is for C-3 General Commercial. This change does not require a land use plan amendment since a review is currently being performed by area citizens. The Land Use Plan is not reflective of the current zoning insomuch as the surrounding C-3 zoned properties are indicated as Low Density Residential, Office and Mixed Use on the Plan. City Recognized Neighborhood Action Plan: This property is located in an area to be covered by the John Barrow Neighborhood Action Plan Review that is currently taking place. This area is north of their original plan area, but will be included in the review area. The initial review of the land use plan amendment would require a large expansion of the application, which would be duplicitous of the actions of the neighborhood plan committee. STAFF ANALYSIS The request before the Commission is to rezone this undeveloped .3 acre tract from MF-12 Multifamily to C-3 General Commercial District. The .3 acre tract is part of a larger 1.98 acre parcel. The northern and southern portions of the larger parcel are already zoned C-3. Once the .3 acres is rezoned, the applicants propose to develop 2 July 6, 2000 ITEM NO.: 1 (Cont. FILE NO.: Z-4328-A the entire 1.98 acre parcel as office warehouse. A conditional use permit to allow office warehouse in C-3 has been filed for the August 3, 2000 Planning Commission meeting (Z-4328-B). Staff is supportive of the rezoning request. The property is'located within the commercial node established at the intersection of Kanis and John Barrow Roads. The properties abutting this .3 acre tract on the north, south and west are zoned C-3. Uses in the immediate area are varied and include a laboratory, offices, a bank, a small commercial shopping center and a plumbing company. The larger area around the intersection includes an even broader range of office and commercial uses. The undeveloped, ME-12 zoned tract adjacent to the east is owned by these applicants. When the previous land owner rezoned the properties to their current zoning pattern, he retained this 50' X 60' MF-12 area to provide possible access from the larger MF-12 property on the east to Barrow Road on the west. The current owners have no desire to take access from John Barrow. Access to both the currently proposed C-3 development and their abutting MF-12 property will be off of Rose Street which enters the site from Kanis Road to the south. The property is located in the Boyle Park Planning District. The Land Use Plan is not reflective of the current zoning in that it does not recognize the existing C-3 zoning in the area generally north of Kanis Road, east of John Barrow. The property is not within an area covered by a neighborhood action plan. The area north of Kanis Road is north of the area covered by the John Barrow Neighborhood Action Plan. That plan is currently being reviewed. As part of that process, the Plan Committee will be asked to expand their review to include this area. It is expected that the review will result in a Plan Amendment recognizing the commercially zoned properties, including this .3 acre tract, as commercial on the Plan. Staff believes the C-3 zoning request is compatible with uses and zoning in the area. No plan amendment is required at this time. 3 July 6, 2000 ITEM NO.: 1 (Cont. STAFF RECOMbENDATION FILE NO.: Z-4328-A Staff recommends approval of the requested C-3 zoning. PLANNING COMMISSION ACTION: (JULY 6, 2000) The applicants were present. There were no objectors present. Staff presented the item and recommendation of approval. The applicants offered no additional comments. The item was placed on the Consent Agenda and approved with a vote of 11 ayes, 0 noes and 0 absent. 4
