RE: Variance on Land Use Buffer
Location: 9125 Stagecoach Road, L.R. (Lot 1 of Stagecoach Crossing Subdivision), on the east side of
Stagecoach road approx 700' from Stagecoach and Baseline.
Reasons for Request:
The adjacent property, to the south, is zoned residential and has commercial zoning to the north
and south (it is an island). The Future Land Use Map shows this property to be zoned commercial.
Because the property to the south of us is shown as future commercial and the adjacent property
owner is planning to re -zone and dose not object to our variance, we are asking for a variance on
the south side of our property to be a landscape strip (as if it were commercial -to -commercial) and
not a Land Use Buffer (commercial -to -residential). This variance would better accommodate our
development of this area because of the existing and proposed slope.

This is to advise you that in connection with your application case no. Z-4325-A, the following action was
taken by the Board of Adjustment at its meeting on September 2$, 2009.

If a variance application is approved by the Board of Adjustment, all permits necessary for the

According to the City's Zoning Ordinance Section 36-70:
"Appeals from the decision of the Board of Adjustment shall be filed with the appropriate court of
jurisdiction. This filing must occur within thirty (30) calendar days of the action by the Board of
Adjustment."

immediately south of Lot 1, this letter will serve as evidence that Diamond Development has no
objection to the rezoning request for Lot 1 to C-3 status, Furthermore, it is the intention of
Diamond Development in the ;Future to request either rezoning to C-3 or request a PCD based
upon the ultimate development of the property. Due to the location of the property, we believe
