HomeMy WebLinkAbout15877 1 RESOLUTION NO. 15,877 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A NATIONAL COOPERATIVE CONTRACT WITH THE 5 INTERLOCAL PURCHASING SYSTEM (TIPS USA); AND FOR OTHER 6 PURPOSES. 7 8 WHEREAS,the City of Little Rock("City")has need to purchase information resources technologies; 9 and, 10 WHEREAS,the National Cooperation Contract allows the City of Little Rock, Arkansas to purchase 11 goods or services through The Interlocal Purchasing System(TIPS USA); and, 12 WHEREAS, through TIPS USA, the City can procure a broad range of information resource 13 technologies and other products through existing vendor contracts and at reasonable prices; and, 14 WHEREAS,the TIPS USA contract will satisfy the competitive bid requirement for the purchase of 15 goods and services; and, 16 WHEREAS, the City shall procure information resources technologies through existing vendor 17 contracts and vendor contracts that TIPS USA may enter during the term of this National Cooperation 18 contract, in accordance with specifications submitted through purchase order; and, 19 WHEREAS,TIPS USA vendor contracts shall be made available to the City,and staff shall utilize and 20 leverage the cooperative contracts by issuing a purchase order directly to the relevant vendors; and, 21 WHEREAS,the City wishes to enter the National Cooperation contract, attached here as Exhibit A; 22 and 23 WHEREAS,authority is granted,and in compliance with the provisions of the Interlocal Cooperation 24 Act, codified at Ark. Code Ann. § 25-20-108, the Interlocal Cooperation Act, Texas Government Code, 25 codified at Section 2054.0565 of the Texas Government Code, and as otherwise provided by applicable 26 law,for out-of-state customers. 27 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 28 OF LITTLE ROCK,ARKANSAS: 29 Section 1. The City Manager is authorized to execute a National Cooperation Contract through The 30 Interlocal Purchasing System,a copy of which is attached hereto for reference as Exhibit A,in compliance 31 with the provisions of the Interlocal Cooperation Act,codified at Ark.Code Ann.§25-20-108,the Interlocal 32 Cooperation Act,Texas Government Code,codified at Section 2054.0565 of the Texas Government Code, 33 and as otherwise provided by applicable law, for out-of-state customers, which will enable the City to 34 purchase information resource technologies without the need for competitive bidding. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 5 resolution. 6 Section 3. Repealer. All resolutions, bylaws, and other matters inconsistent with this resolution are 7 hereby repealed to the extent of such inconsistency. 8 ADOPTED: February 7,2023 9 `..
