AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
COMMERCIAL DISTRICT TITLED HILLCREST SQUARE
REVISED PCD (Z -4251-B), LOCATED AT 3000 KAVANAUGH
BOULEVARD, LITTLE ROCK, ARKANSAS, AMENDING THE
OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND
FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from PCD to Revised PCD:
Lots 4, 5 and 6 in Block 54, Pulaski Heights Addition to the City of
Little Rock, Pulaski County, Arkansas.
SECTION 2. That the approval of Hillcrest Square Revised PCD (Z -4251-B), located at
3000 Kavanaugh Boulevard is subject to compliance with the following additional
conditions:
That the preliminary site development plan/plat be approved as submitted,
including all staff comments and conditions as outlined in the Planning
Commission Agenda Staff Report in paragraphs D, E, F and including any
conditions indicated in the staff analysis in paragraph H and subject to
additional conditions imposed at the Planning Commission Public Hearing
as amended by the applicant.
SECTION 3. "That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 4. That the change in zoning classification contemplated for Hillcrest Square
Revised PCD (Z -4251-B), located at 3000 Kavanaugh Boulevard is conditioned upon
obtaining a final plan approval within the time specified by Chapter 36, Article VII,
Section 36-454 (e) of the Code of Ordinances.
SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 6. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 7. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

The applicant is proposing to amend the previously
approved PCD to change the percentage of allowable
commercial and office uses for the site. The proposal is to
allow 60% of the gross floor area for commercial• uses and
40% of the gross floor area as office uses.
None.
Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 6 ayes, 0 noes, 4 absent
and 1 open position.
The Planning Commission reviewed the proposed PCD
request at its May 24, 2007, meeting. There were no
registered objectors present. The Hillcrest Residents
Neighborhood Association, all residents who could be
identified located within 300 feet of the site and all property
owners located within 200 -feet of the site were notified of
the Public Hearing.
BACKGROUND
On October 2, 1984, the Board of Directors adopted
Ordinance No. 14,747 rezoning the site from 0-3 to PCD to
allow a mixed office/commercial development. There was
an existing 14,647 square foot (net area) building on the
site which had previously been utilized as a church. The
PCD was approved for 6,407 square feet of
commercial/retail space (44%) and 8,240 square feet of
office space (56%).
Ordinance No. 18,204 adopted by the Little Rock Board of
Directors on February 15, 2000, revised the previously
approved PCD site plan by adding approximately 900
square feet of deck and patio area to the east side of the
building to serve the existing restaurant use. The deck area
would be used for a dining and waiting area. The proposal
allowed the enclosure of an existing porch for use as
additional waiting area. A new building service ramp was
also proposed. The existing hours of operation for the
Acadia Restaurant were from 11:00 am — 2:00 pm, 5:00 pm
— 10:00 pm Monday through Friday; 5:00 pm — 10:00 pm
Saturday and closed Sunday.
As a condition of approval the deck is to remain
uncovered/unenclosed. There are to be no outdoor
speakers, entertainment, etc. There is to be no
cabaretinightclub with Mance floor on the property. All site
lighting must be low-level and directed away from the
adjacent property/street.
The applicant is now proposing to amend the previously
approved PCD to change the percentage of allowable

conditions remain unchanged and continue to apply.

To follow up on our meeting of last month regarding the Parking Lot Lease at Kavanaugh
and Monroe Street I would make the following proposal.
Your existing lease expires on March 31, 2006 and your current rent is $500.00 per
month. The rent was scheduled to increase to $717.22 per month in 1995 but was renegotiated to
$500.00 per month at that.time for five more years. We extended the lease five additional years
in January, 2000 at the same rate in order to help you recover some paving cost. I know you
would like a long term commitment on the Lot but all we are willing to do at this time is to
extend the lease for five additional years at a rate of $650.00 per month. This amount is arrived
at by applying -the cost of living increase since for the last ten years to your current rate. A copy
of that computation is attached.
Should you have plans to redevelop the property at a later date or have a prospective
buyer that would need the lot we will be willing to sit down.with you at that time and try to
structure an agreement that is favorable to both parties. In the meantime we feel our above
mentioned offer is fair given the current circumstances.
If this is agreeable please indicate in the space provided below and return a copy for our
files. This would increase your current lease to March 31, 2011. Please call if you have any
questions.

Lessor and shall name the Lessor as an insured party on all
of such policies.
Use of Property: The demised premises shall be used
solely for the purpose of providing off-street parking and
shall not be developed for'any other purposes; provided, how-
ever, it is expressly agreed and understood that Lessor reserves
and does not convey by this Lease all of its right, title and
interest in and to an advertising structure for a double -deck
poster panel or signboard, which is located on the demised pro-
perty, and also the right of ingress and egress on and across
the demised premises for the purposes of access to and mainte-
nance of said advertising structure and the poster panels thereon.

this lease for one (1) additional ten (10) year term from the
expiration of the original term hereof. The option shall be
exercised by written notice to Lessor, not less than three (3)
months prior to the expiration of the then current term. The

ditions as provided during the initial term, except that the
monthly rental payable during this option period shall be an
amount equal to the monthly rent at this lease commencement
times the ratio that the Consumer's Price Index for the United

Ontion to Purchase: It is understood and agreed that the
Lessee shall have an option during the term of this lease to
purchase the property at the same terms and conditions as

the Lessee ten (10) days in which to accept or refuse the
terms offered by said bona fide purchaser. If the Lessee
elects to purchase the -property, -.he shall mail a written
notice to the Lessor signifying his -intention to purchase
the property upon said terms; and -shall agree to carry out
said purchase within thirty (30) dyas thereafter. If the
Lessee shall not elect to purchase the property, the Lessor
shall have the right to cancel this lease upon sixty (60)
days written notice. It is understood and agreed that nothing
in this option shall give the Lessee the right to initiate a
purchase. If the Lessor does not notify Lessee of his inten-
tion to sell this option is without meaning.
Right Upon Default: If the Lessee shall neglect or fail
to perform or abserve any of the -covenants contained herein
on its part to be observed and performed -for ninety (90) days
after written notice -by the Lessor of such breach, or if the
Lessee shall be adjudicated bankrupt or insolvent according to
law, or shall make an assignment for the benefit of creditors,
then and in any of said cases the Lessor may lawfully enter
into and upon the said premises or any part thereof in the name
of the whole, and repossess the same, and expel the Lessee and
those claiming under and through it and remove its property,
forcibly if necessary, without being deemed guilty of any manner
of trespass; and without prejudice to any remedies which might
otherwise be used for arrears of rentor preceding breach of
covenant, and upon entry as aforesaid, this Lease shall termi-
nate and wholly expire, and the Lessee covenants that in case
of such termination it will indemnify the Lessor against all
loss of rent which the Lessor may incur by reason of such
termination during the residue of the term above specified.
Holding Over: Notwithstanding any other provision of law

or any judicial decision to the contrary, no notice shall be
required from either party to terminate this Lease on the
ultimate expiration date herein specified, and anything here-
in contained or implied: -to -the contrary, notwithstanding a
holding over by the Lessee, its assignee or sublessee beyond
the expiration of said term shall give rise to a tenance from
month to month only.
Notices: All notices to be given hereunder by other parties
shall be in writing and given by personal delivery to the Lessor
or the Lessee, or shall be sent by registered mail addressed to
the party intended to be notified at the post office address
of such party last known to the party giving such notice, and
notice given as aforesaid shall be sufficient notice thereof,
and shall be deemed given as of the date when deposited at
any post office, or in any post office box regularly maintained
by the Federal Government.
Amendments: This Lease shall bind the Lessor and Lessee
herein, their successors and assigns, and no waivers, altera-
tions, or modification of this Lease shall be valid unless
written upon or attached to the fully executed copies of this
Lease and further executed by both the Lessor and Lessee here-
in.

Pursuant to'Order Number 89-90, dated August 24, 1989, the
Director of the Office of Thrift Supervisionij appointed the
Resolution Trust Corporation as Receiver of HomellFederal Savings
and Loan Association, Mountain Hone, Arkansas (hese nafter referred
to as the "Association"), said appointment was "made pursuant to
§ 5 (d) (2) (Ii) (ii) of the Home Owners' Loan Act of 1933, as amended
by 5 301 of the Financial institutions .Reform, Recovery, and
Enforcement Act of 1989. As the Association's Receiver, pursuant
to terms of a Lease Agreement and an Assignment of Deed of Trust
as Modified and Extended, the Resolution Trust Corporation is the

I have reviewed our file on the above referenced lease after you called yesterday. The
original lease was for twenty years with one ten-year option. At the end of the 20 -year primary
term the rent was scheduled to increase to $717.22 per month. The owner at the time negotiated a
five-year renewal at $500.00 per month in lieu of the 10 -year renewal at the scheduled rate.
It is my understanding that the lot is in need of resurfacing and your owner would like to
have more time to amortize his expense than the fourteen months remaining under the existing
option. We would be agreeable to extending the existing option for five more years at the
existing terms if you wish to resurface the lot. This would extend the current lease until March
31, 2006.

The hearing on the PCD for Hillcrest Square is about resetting the
percentages that are down for percent commercial and percent office (44
to60 and 56 to 40) . There will be no additional addition to the building.
None of you would notice any difference in what is already going on. Do to
zoning rules, like a Chiropractor is supposed to be in C and a No can be in
office zoning, I need to align the PCD more with what we are doing. Phillip
Vines is moving out and going to a new location. The City allowed him to
fit in office category because his practice was different then other
Chiropractors.
I just wanted to reassure all of you that there was no visible changes
happening to the building, other then the painting, and I hope you all like
the fresh look.
