Staff Analysis: Z -4236-A Richard Toll 11225 Huron Lane Lot 29, Charles Valley Subdivision O-3 From the area regulations of Section 36-281(d) to permit construction of a two-story building addition with a reduced rear yard setback. Construction of a building addition is vital to the needs of the tenants of the existing building. Design constraints limit the placement of the addition to this location. Office Office The applicant proposes to construct a two-story, 1,050 square foot addition to the rear of this existing office building. The resulting rear yard setback will be ten feet. The ordinance requires a twenty-five foot setback. Surrounding uses are almost exclusively offices and this building has a rear yard arrangement with the side yard of a building which fronts onto Shackleford Plaza. A drainage way and driveway give a total separation of approximately 30 feet from the proposed new addition to the building on the lot to the rear. The applicant states that design constraints of the existing structure's mechanical and electrical systems limit placement of the addition to this location. September 26, 1994 tem No.: A (Cont. C. staff Recommendation: Staff recommends approval of the requested rear yard setback variance. BOARD OF ADJUSTMENT: (AUGUST 29, 1994) The applicant was not present. There were no objectors present. Staff presented the item and informed the Board that the applicant had put the wrong month on the notices which were sent to adjacent property owners. once the applicant had been made aware of his error, he had requested that this item be deferred to the September 26, 1994 meeting. Corrected notices will be sent. A motion was made to defer the item to the September 26, 1994 meeting. The motion was approved by a vote of 6 ayes, 0 noes, 1 absent and 2 open positions. BOARD of ADJUSTMENT: (SEPTEMBER 26, 1994) The applicant's representative, Pat MCGetrick, was present. There were no objectors present. Staff presented the item and informed the Board that corrected notices had been sent. Mr. MCGetrick addressed the Board and gave a brief description of the proposed addition. A motion was made to approve the requested rear yard setback variance. The motion was approved by a vote of 7 ayes, 0 noes, 1 absent and one open position. 2
