I am enclosing a copy of the Proposal and Acceptance signed by Scott Smith of Birnam Wood. If your investigators go out there you will find that culvert is being laid and the parking lot is being prepared for asphalt paving. Birnam Wood was granted an easement until July 1, 1991 to pave their parking lot. That work has not yet been performed. My clients wish to attend the upcoming hearing at the next meeting of the planning board. They are still experiencing cash flow difficulties, and have received an estimate for paving the parking lot that is approximately $8,000.00. Birnam Wood Nurseries requests a waiver of the City's requirement that their parking lot be paved. The principal officers of Birnam Wood will attend the hearing to present their case.
