Paar Dover Drive Rezone from MF -6 and MF -18 to R-2 Single-family 1.9 acres Vacant SURROUNDING LAND USE AND ZONING: North - Vacant and single-family, zoned R-2 and MF -18 South - Single-family, zoned R-2 East - Single-family and Park, zoned R-2 West - Vacant and Church, zoned R-2 and MF -18 STAFF ANALYSIS• In 1984, the lots in question were rezoned to MF -18 and MF -6 as part of a large zoning action that involved close to 200 acres. There are a total of 9 lots along this portion of Dover Drive, and they are platted for single-family development. Seven of the lots are vacant, as are the MF -12 and MF -18 areas to the north. Dover Drive is an improved street with a 60 foot right-of-way and terminates at the northernmost lot under consideration. The owner now feels that detached single-family units are the best use for the lot and that is how they are being marketed. Two of the lots along Dover were rezoned to R-2 in 1990 to permit the construction of a single-family residence. The house has been completed and is occupied. Zoning in the general vicinity is R-2, MF -12, MF -18, PCD, and OS. The land use is primarily single-family, with a significant percentage of the land undeveloped. Other uses found in the immediate area are a church and a facility for United Cerebral Palsy. 01 April 9, 1991 ITEM NO.: I Z -4175-D (Cont.) Staff views single-family development as being more realistic for the lots and supports the R-2 reclassification. The I-430 District Plan reflects the existing zoning and shows the lots for multi -family use. It is the staff's position that the R-2 zoning will not alter the basic direction of the plan, and the inconsistency between the zoning action and the plan is an insignificant issue. (All the lots need to be final platted prior to any sales taking place.) ENGINEERING COMMENTS: None reported. STAFF RECOMMENDATION: Staff recommends approval of the R-2 request as filed. PLANNING COMMISSION ACTION (April 9, 1991) The applicant was present. There were no objectors and the item was placed on the consent agenda. A motion was made to recommend approval of the R-2 as filed. The motion passed by a vote of 7 ayes, 0 nays, and 4 absent. 2
