PLANNING CONSIDERATIONS:
1. There is an existing structure on the property that is
occupied by a wholesale operation, a nonconforming use.
The proposal is to rezone the site to be in conformance
with the use. If the zoning is approved, the use of
the building may be expanded to include some
warehousing. The building can also be enlarged because
of the way it is sited on the property. The applicant
filed the request because of an enforcement issue. The
building was previously used for a number of commercial
purposes.
2e The site is flat with only the one building on it.
Between the building and the access road, there is a
large open area that has been used for parking.
3. There are no right-of-way or Master Street Plan
requirements associated with this request.
4. There have been no adverse comments received from the
reviewing agencies at this time.
5. There are no legal issues relevant to this application.

6. The property was part of the large annexation that took
place in 1979 and brought in as "R-2." There are a
number of nonconforming uses in the area, because the
properties shall remain "R-2."
7. The site is located in an area that has a number of
different uses ranging from commercial to a mobile home
park. Because of the existing development that is in
place, staff views the use and rezoning as being
compatible with the surrounding land uses. The use
will not generate heavy traffic loads or create any
additional impacts on the area. Previous use of the
building included a nightclub which did present some
problems for the area.
STAFF RECOMMENDATION:
Staff recommends approval of the application as filed.
PLANNING COMMISSION ACTION:
The applicant was present. The Commission discussed the
case briefly. A motion was made to recommend approval of
the application as filed. The motion passed by a vote of
9 ayes, 0 noes and 2 absent.
