Site Location Max Mart - Conditional Use Permit 13,625 Vimy Ridge Road Coy Dean/Sidney McKay, Agent This item is associated with Item No. 17, a proposal to rezone the site from C-1 to C-3. The applicant proposes to construct a convenience store with gas pumps and a car wash on this site. The car wash requires a conditional use permit in C-3. The site is located at the northeast corner of Vimy Ridge Road and County Line Road, adjacent to the Saline/Pulaski County line. 2. Compatibility with Neighborhood Large vacant tracts of R-2 zoned property comprise the majority of the uses in the immediate vicinity. Directly east of this site is a vacant tract zoned MF-6. Northeast of this site is Irish Springs Estates, a single family residential subdivision. This site is located at the intersection of two minor arterial streets and with proper attention given to screening the adjacent residential properties to the north and east, should be compatible with the neighborhood. 3. On -Site Drives and Parkin The applicant is proposing to construct a large open drive/parking area as is typically associated with this type of operation. There will be eight parking spaces, two of which are designated as handicapped. The car wash will be accessed by a one way drive circling behind the store. 4. Screenino and Buffers Compliance with the City's landscape and buffer ordinances is required with consideration given to the adjacent residential properties to the north and east. City Engineer Comments Master Street Plan improvements and right-of-way dedication is required to County Line Road and Vimy Ridge Road; both minor arterials. 6. Utility Comments None as of this writing. 7. Analysis This item is associated with Item No. 17 (Z-4120-A), a request to rezone this property from C-1 to C-3. This proposal is contingent upon the C-3 zoning since the attached car wash takes both C-3 zoning and a conditional use permit. The proposed car wash is an enclosed automatic operation as is associated with many newer convenience stores with gas pumps. Attention must be given to screening the adjacent residential properties. 8. Staff Recommendation Staff recommends approval of this application subject to compliance with City Engineer's comments and compliance with the City's landscape and buffer ordinances. SUBDIVISION COMMITTEE COMMENT: (JANUARY 7, 1993) The applicant was not present. Staff presented the proposal and outlined the concerns listed in the staff recommendation. Jerry Gardner, of the City Engineer's Office, explained the need for right-of-way dedication and Master Street Plan improvements to both County Line Road and Vimy Ridge Road. Staff informed the Committee that a revised site plan would need to be submitted showing the new right-of-way because it may require a shift of the building and parking lot to the north and east. The Committee then forwarded this item to the full Commission for final resolution. PLANNING COMMISSION ACTION: (JANUARY 26, 1993) The applicant was present. There were no objectors present. Dana Carney of the Planning staff presented the item and a staff recommendation of approval. He informed the Commission that a revised site plan had been submitted which complied with staff concerns regarding right-of-way issues.
