Fulmore PROPOSAL: A conditional use permit is requested to allow for the removal of an existing single -wide mobile home and the placement of a 28 foot by 60 foot multisectional, manufactured home on this R-2 zoned, 3.43 acre site. This application is associated with Item No. 23 (Z -4098-B), a request to rezone the south 300 feet of this property from I-1 to R-2. ORDINANCE DESIGN STANDARDS: 1. Site Location This property is located on the north side of Alexander Road, just west of its intersection with Sardis Road. 2. Coulpatibility with Neighborhood This property is located in a rural setting comprised primarily of single family homes on larger tracts and large areas of vacant farm/grazing land. A heating and air conditioning company is located several hundred feet to the west. In the immediate vicinity, all of the property on the north side of Alexander Road, including this site has been rezoned to 0-3, C-2, I-1, I-2 and I-3. For the most part, these properties are still either vacant or used as single family residential. A vacant, 0-3 zoned tract is adjacent to the east. An I-2 zoned tract, occupied by a single family residence is adjacent to the west. The property to the south, across Alexander Road, is zoned R-2 and occupied by several single family residences. This property will continue to be used as single family residential for the foreseeable future and the proposed use is compatible with the neighborhood. Screening and Buffers None required for this proposed single family residential use. 5. City En in er Comments No comments. Any needed right-of-way will be required through the rezoning (Item No. 22, File No. Z-4098-8). 6. Utility Comments No comments 7. Analysis This property was rezoned I-1 and I-2 as part of a large 22.8 acre rezoning in 1983. It has continued to be used as single family residential since that time. The applicant proposes to remove the existing, single -wide mobile home and replace it with a new, double -wide manufactured home. To do this, the applicant has submitted a request to rezone the south 300 feet of his property to R-2 and has filed an application for a conditional use permit. 8. Staff Recommendation Staff recommends approval of this application subject to 1. Compliance with the City Engineer Comments. 2. Compliance with the Ordinance established minimum siting standards as follow: a. A pitched roof of 3 in 12 or 140 or greater b. Removal of all transport elements C. Permanent foundation d. Exterior wall finished so as to be compatible with the neighborhood e. Orientation compatible with placement of adjacent structures f. Underpinning with permanent materials g. Compliance with all applicable building codes SUBDIVISION COMMITTEE COMMENT: (OCTOBER 28, 1993) Mr. and Mrs. Sim Fulmore were present. Dana Carney, of the Planning staff, presented the item. The Committee was informed by the City Engineers Office that an additional 5 feet of right-of-way dedication was required for Alexander Road. Mr. Fulmore stated that he had already dedicated 40 feet of right-of-way in 1983 and had questions as to why the additional 5 feet was required. He was informed that the Master Street Plan now called for the additional right-of-way. Mr. Fulmore was told that he should go to the Board of Directors to request a waiver of the additional right-of-way dedication if he did not wish to comply with the Master Street Plan requirement. The Committee determined that there were no other issues and forwarded this item to the item to the full Commission for final resolution. PLANNING COMMISSION ACTION: (NOVEMBER 16, 1993) Mr. and Mrs. Sim Fulmore were present. There were no objectors present. Staff presented the item and informed the Commission that there were no outstanding issues. The Commission then placed this item on the Consent Agenda for approval subject to: 1. Compliance with the City Engineer Comments 2. Compliance with the Ordinance Established Minimum Siting Standards as outlined in the staff recommendation 3. Compliance with all applicable building codes The vote was 8 ayes, 0 noes, 2 absent and 1 open position. 3
