Location: 1602 Abigail
Request: Rezone from "C-3" General
Commercial to "R-3" Single Family
This property has had numerous zoning violations stemming
from parking cars in the right-of-way and impeding traffic
flow. An auto garage has operated at this location for many
years.
The residents of the area petitioned the Board of Directors
to down zone the property to "R-3." This action was taken
on October 4, 1983.
The City Attorney has since informed us that the Board of
Directors should not have rezoned the property without
Planning Commission review. He suggested that the property
be sent to the Commission.
The staff recommends the down zoning from "C-3" to "R-3."
We do not feel that further Planning Commission action is
necessary, but wanted to fulfill the wishes of the City
Attorney. Down zoning is consistent with the Oak Forest
Neighborhood Plan.

PLANNING COMMISSION ACTION_
Jim Lawson explained the various issues involved in the down
zoning. He stated that a Planning Commission review of the
rezoning action would clarify the issue. Several of the
commissioners expressed concern over a down zoning action
without the property owner initiating the process. Jim
explained that a letter is on file stating that the owner
does not object to the rezoning action.
After further discussion, the Planning Commission voted
11 ayes and 0 noes to recommend approval of the "R-3"
rezoning.
