3 A RESOLUTION TO EXPRESS THE WILLINGNESS OF THE CITY OF
4 LITTLE ROCK, ARKANSAS, TO PARTICIPATE IN A COST SHARING
5 AGREEMENT WITH PULASKI COUNTY AND WOODLAND HILLS
6 VALLEY, LLC, FOR IMPROVEMENTS TO COOPER ORBIT ROAD;
7 AND FOR OTHER PURPOSES

9 WHEREAS, Pulaski County, Arkansas and Woodland Hills Valley, LLC, has implemented plans to
10 relocate a segment of Cooper Orbit Road;and,
11 WHEREAS, the improvement project requires relocation of a segment of Cooper Orbit Road to
12 Panther Branch Drive between Kanis Road and Glisten Lane; and,
13 WHEREAS,it is desirable for the City of Little Rock(City)to partner with and participate in the cost for
14 improvements to Cooper Orbit Road.
15 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
16 THE CITY OF LITTLE ROCK, ARKANSAS:
17 Section 1. The City will participate in the Cooper Orbit Relocation Project in an amount not to exceed
18 One Hundred Five Thousand, Seven Hundred Twenty-Two Dollars($105,722.00), in accordance with the
19 signed Memorandum of Understanding between the City, Pulaski County, Arkansas, and Woodland Hills
20 Valley, LLC. The amount includes 20% construction contingency for the proposed alignment of Cooper
21 Orbit Road and Kanis Road.
22 Section 2. The Mayor or City Manager,or their designee,is hereby authorized and directed to execute all
23 appropriate agreements and payments necessary to expedite the construction of this project.
24 Section 3. Funding for the City share of this project is from the Street Fund Special Projects.
25 Section 4. Severability. In the event any title,section,paragraph,item,sentence,clause,phrase,or word
26 of this resolution is declared oradjudged to be invalid or unconstitutional, such declaration or adjudication
27 shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the
28 portion so declared or adjudged invalid or unconstitutional was not originally a part ofthe resolution.
29 Section 5. Repealer. All laws,ordinances,resolutions,or parts ofthe same,that are inconsistent with the
30 provisions of this resolution, are hereby repealed to the extent of such inconsistency.
