RESOLUTION NO. 4 15,758(SEPTEMBER 6,2022),TO AUTHORIZE THE CITY MANAGER TO 5 AMEND THE CONTRACT WITH BILL'S FENCE COMPANY, INC., IN A 6 REVISED AMOUNT NOT TO EXCEED ONE HUNDRED FIVE 7 THOUSAND, THREE HUNDRED TWENTY-SIX AND 20/100 DOLLARS 8 ($105,326.20),TO ADD ENGINEER-APPROVED SPECIFICATIONS FOR A 9 PERMITER FENCE AT THE LITTLE ROCK ZOO; FOR AND FOR 10 OTHER PURPOSES. 11 12 WHEREAS,Little Rock,Ark.Resolution No. 15,758(September 6,2022)authorized the replacement 13 of the six(6)-foot Perimeter Wood Fence behind the Zoo Maintenance Shop with an eight(8)-foot Wood 14 Fence with new galvanized steel posts with baseplates and anchors to meet the standards of the Association 15 of Zoos and Aquariums(AZA) for the Little Rock Zoo(Zoo); and, 16 WHEREAS,the contract was awarded to Bill's Fence Company, Inc.,(Bid No. 1799) with a bid total 17 of Fifty-Nine Thousand, Eight Hundred Twenty-Seven Dollars($59,829.00);and, 18 WHEREAS, it has been determined that a new fence must be constructed alongside Interstate 630 19 where the structure rests on a concrete slab that presents challenges for fence construction and requires 20 coordination with the Arkansas Department of Transportation(ArDOT);and, 21 WHEREAS,ArDOT requires the use of an Engineer to asses wind stress on the fence to ensure safety 22 of the fence for motorists below; and, 23 WHEREAS,the Zoo requests the Contract with Bill's Fence Company, Inc., be amended to include 24 the cost of the additional fencing plus A 20%contingency for total additional sum of Forty-Five Thousand, 25 Four Hundred Ninety-Nine and 20/100 Dollars($45,499.20)with a total amended Contract amount of One 26 Hundred Five Thousand,Three Hundred Twenty-Six and 20/100 Dollars($105,326.20). 27 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 28 OF LITTLE ROCK,ARKANSAS: 29 Section 1. The City Manager is authorized to amend the Contract with Bill's Fence Company, Inc., 30 to add Engineer-approved fencing along Interstate 630 which meets the Association of Zoos and Aquariums 31 and the ArDOT wind stress safety standards for perimeter fences. 32 Section 2. Funds for the total amended contract amount of One Hundred Five Thousand, Three 33 Hundred Twenty-Six and 20/100 Dollars($105,326.20) is available in the Zoo Capital Fund,Account No. 34 326659-TS65A79. [Page 1 of 21 1 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 2 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 3 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 5 resolution. 6 Section 4. Repealer.
