A variance is requested from the
area regulations of Section 36-254
to permit a reduced rear yard
setback of 2 feet.
The existing home is in need of
repairs that would cost more than
building a new home. The applicant
desires to maintain the existing
front yard setback while building a
home large enough to accommodate
the needs of his growing family.

removed or request abandonment of alley right-of-way.
B. Staff Analysis:
The R-2 zoned property at 2206 Country Club Lane is
currently occupied by an older, one-story frame residence.
The owners propose to remove this structure and replace it
with a new, large two-story home. In order to maintain the
40-45 foot front yard setback which is typical of homes on
this street, the applicant proposes to push the new home
closer to the rear property line, creating a rear yard
setback of 2 feet. The code requires a rear yard setback of
25 feet.
While staff is supportive of some reduction in the required
rear yard, we cannot support such a dramatic reduction (25
feet reduced to 2 feet). The potential impact of a two

story structureiwith a setback of two feet on adjacent
properties is too great.
There are circumstances which do support a reduced rear
yard. A 10 foot wide alley right-of-way separates this site
from the adjacent property to the rear. The alley right-of-
way has never been developed and it does provide additional
open space and separation. As proposed, the new
construction does well exceed all other required setbacks on
the sides and front. There is more open space left on the
property than is typically found on lots in the Heights
area. The main body of the house is located out of the
required setback area. The only portion of the proposed
house which intrudes into the required rear yard is 25 feet
wide; a relatively small intrusion on a 100 foot wide lot.
Staff believes, at the very least, a minimum rear yard of 5
feet should be required with the eave/overhang limited to 12
inches. This will provide a reasonable area between the
house and the property line for maintenance and open space.
As indicated by the Public Works Department, the applicant
should pursue abandonment of the alley right-of-way. This
will add 5 feet to the depth of the property, and reduce the
amount of the setback variance.
C. Staff Recommendation:
Staff recommends denial of the requested setback variance to
allow a rear yard setback of 2 feet.

The applicant was not present. There were no objectors present.
Staff informed the Board that the applicant had requested that
the item be withdrawn.
The item was placed on the Consent Agenda and withdrawn with a
vote of 7 ayes, 0 noes, 0 absent and 2 open positions.
