Watt Address: 1819 Filmore/5623 "R" Street Description: Lot 11 and the West 100 feet of Lot 12, Block 12, Mountain Park Addition Zoned: c-3 Variance Reggested: A variance is requested from the area regulations of Section 36-301 to permit construction of an addition with a reduced rear yard setback of 15 feet. The ordinance requires a rear yard setback of 25 feet. A variance is also requested from the off-street parking regulations of Section 36-502 to permit a reduction in the number of required on-site parking spaces. This approximately 3,450 square foot office building will require 8 on- site parking spaces. The property will have 6 spaces. Justification: The applicant's portion of Lot 12 is only 100 feet deep, limiting the availability of buildable area. The internal design of the existing building in relationship to the proposed addition requires that the addition be placed on the east end of the building. The proposed addition is to expand two existing offices. There will be no additional employees requiring parking spaces. Dedication of additional right-of-way is requested. B. Staff Anal sis : The applicant proposes to construct a 10 foot by 25.9 foot addition onto the east end of this existing, one-story Office building. The proposed addition will have a reduced rear yard setback of 15 feet. The ordinance requires a rear yard setback of 25 feet in the C-3 zone. The applicant's portion. of Lot 12 is only 100 feet deep and has a side yard relationship to the property to the east. No side yard setback is required between abutting C-3 zoned properties. Staff feels that the requested 15 foot setback is adequate and supports the variance request. As is true of many businesses in the Heights Commercial District, this property does not have enough on-site parking spaces to meet ordinance requirements. The existing 3,200± square foot building requires 8 on-site parking spaces. There are currently 7 spaces on --site. Once the 259 square foot addition is constructed, one of those spaces will be lost• leaving 6 on-site parking spaces and a requirement of 8. Staff recognizes the unique nature of the Heights Commercial District and is sensitive to the area's parking requirements. It is felt however, that this proposed 1 space parking variance will not negatively impact the adjacent neighborhood and staff supports the requested parking variance. There is a small amount of space available at the rear of Lot 11 and staff would urge the applicant to explore the Possibility of constructing an additional parking space in this area. C. Staff Recommend tion: Staff recommends approval of both the requested rear yard setback variance and the parking variance. B ARD CF' ADJUSTMENT: (DECEMBER 27, 1994) The applicant, William Watt, was present. There were no objectors present. Staff presented the item and a recommendation of approval. 2 December 27, 1994 Item No.• 1 Cont. Mr. Watt briefly addressed the Board. He stated that the proposed addition is to enlarge two, existing offices and that no additional persons would be added. Mr. Watt also stated that it was his intention to explore the possibility of adding an additional parking space on the rear of Lot 11. A motion was made to approve the requested rear yard setback and parking variances. The motion was approved by a vote of 7 ayes, 0 noes, 1 absent and 1 open position.
