Dear Mr. Gravitt:
On .lune 4, 1985, the City Board of Directors passed an ordinance establishing the above
referenced PCD. That PCD approved use of the site as follows: areas A & B (7,405 sf &
2,928 sf respectively) were for commercial uses and area C (the rear 7,800 so was for office
use. This was in conformance with the Planning Commission recommendation and with
your letter dated May 9, 1985 which stipulated that the uses of the office area be approved
for "general office uses under the O-1 office zoning rules".
The zoning enforcement officials have noted that the rear area is not in conformance with
the requirements of the PCD which was established. After a notice from the enforcement
officer, you asked by letter dated December 1, 1993, to be placed on the "next zoning
commission meeting' to seek rezoning to accommodate the tenants. This would have put
you on the February 8, 1994 Planning Commission agenda. I called you prior to the cut-off
date for getting on that agenda, asking that you furnish me with additional information
and that you come to my office to discuss the situation. I have not heard from you since.
The next cut-off date for filing for a PIanning Commission agenda is February 14, 1994 for
a March 22 Commission meeting. By February 14, you need to have paid your filing fee
($125.00), filled out the application form to modify the PCD, and furnished me with a
complete narrative description of the current activities and how you want the PCD list of
approved uses changed. This request will then go to the Planning Commission for review
and to the Board of Directors to pass a new ordinance amending your PCD. You wilt have
to post a sign for neighbors to be advised of the proposed action, and you will have to get a
list of property owners within 200 feet and send notices out to these people by certified mail.
You need to contact me within the next week. We need to go over the requirements for
amending the PCD and you need to get a title company started with the list of area
property owners. Unless we make this next Planning Commission deadline, the matter will
be returned to the enforcement officer to take legal action to stop the illegal uses of the
property. Please call me at 371-6814 to discuss this matter.

The part of the University Center which Dance .America occupies is restricted to "O-1,
Quite Office" uses. This restriction is imposed on the rear 7,800 square feet of the
University Center building. The O-1 zoning district uses include a dance studio, (see the
copy of Section 36-279 of the Code of Ordinances, attached), but a dance studio is limited
to a studio which provides "instructing, counselling, or coaching in the arts, developing
personal skills and/or talents". (See copy of definitions section of the Code, attached.) The
restrictions impose very strict limitations on the allowable use.
At yesterday's Planning Commission meeting, it was reported that, in addition to the dance
studio, you allow the facility to be used for parties or other forms of entertainment. Such
uses would be in violation of the allowable uses for your business. The Planning
Commission has deferred finalizing action on the request to rezone the rear 7,800 square
feet of University Center to allow commercial uses pending a determination on the abuse of
the zoning district which neighboring property owners have reported. The City's zoning
enforcement personnel will also be expanding their investigation of the uses which are in
violation of the Zoning Ordinance.
The hearing of the University Center request to amend the allowable uses for the Center
was deferred until the April 5, 1994 Planning Commission hearing. At that meeting, I
would guess that the Commission will impose a restriction on the hours of operation and on
noise of facility tenants, since the whole idea in approving the zoning originally was for
"quiet" office uses.

The applicant's PGD is also known as University Center, and is Icoated at the northwest
corner of Wanda Ln, and the I-30 access road/Univeristy Ave. Denise Dr. is immediately to
the west, and some of the houses on the east side of Denise Dr, back up to University
Center. House to the north of the Center on Wanda Ln. are affected by the PCD. From
the north property Iine of University Center to Mabelvale Pike/Forbin g Road is 920 feet.
None of the area south of Forbing Road and north of I-30 is within an identified
neighborhood association. Therefore, only notification of property owners within 200 feet
of University Center was accomplished. This involved notifying 22 owners of 24 lots.
At the time this application was first'submitted, there was no contact person identified for
the neighborhood association which extends north of Mabelvale Pike/Forbing Road to W.
65th. Street (beyond 920 feet away); therefore, the applicant was notgiven anyone in that
association to contact. Subsequent to the Board's agenda meeting on May 11, I
provided with a contact in this neighborhood, the Ponderosa/Brookwoodwas
neighborhood
Association, Mr. Hugh Williams, 7108 Morgan Dr., and have handled notifying horn of the
Board meeting Tuesday evening and the action proposed.
At the same time, pursuant to comments by Board members, I have provided notices of the
pending action to: the Meadowcliff Neighborhood Association (north of W. 65th. St.),
Wakefield Neighborhood Association (east of University Ave.), and the Cloverdale
Neighborhood Association (south of I-30).
Over the past several weeks since the item was originally heard, I have had a number of
telephone conversations with the most directly affected neighbor/the neighbor who spoke at
the Commission meeting. That gentleman is Mr. Donald Tourney. He was satisfied with
the results of the Commission's action to curb the Dance America abuse and the dumpster
servicing of the pizza delivery business at 2:00 AM. He, nor any of the other area residents I
spoke with prior to the Commission hearing, had any concern regarding the three "illegal"
uses (the book store, the beauty shop, and the cleaners). I have also notified him of the
pending action before the Board on Tuesday evening.
Interestingly, when I called Mr. J. R. Purifoy, president of the Wakefield Neighborhood
Association, to find out how to get him a notice, he questioned the need to notify the
Wakefield Association, since the proposed action involved a property which is not only
totally out of the Wakefield neighborhood, but it across University and down I-30. He
stated that the Wakefield Association would not and should not have any input into a
Proposed action which is outside its neighborhood and did not affect the neighborhood.

Attached is a copy of the minute record from the April 5, 1994 Planning Commission
hearing on the amendment to the PCD for University Center to allow mixed C -I and O -I
uses on the rear 7,800 square foot portion of the Center. You will note that the
Commission approved the mixture of uses on a 50%-50% basis. This will allow the current
C- I uses to remain. There were also restrictions placed on the Dance America activities and
on the dumpster servicing times.
The item now goes to the Board of Directors for approval of an ordinance amending the
original PCD ordinance. The Board meeting will be on May 17, I994. These meeting start
at 6:00 in the evenings, and are held at City Hall in the Board of Directors chambers.

The proposed 6 ft. high opaque wood fence needs moved eastward 4 ft to provide
greenspace between the vehicular use area and screening fence. This fence must be
the good neighbor type. The durupster must be encic-)scd on three sides frith an 8 ft.
high opaque wall or fence. *The plan submitted is snort of the 6% interior
landscaping required by 270 sq. ft.

The landscaping has deteriorated and needs to be fully reinstalled and maintained.

Landscape areas equal to a 3 ft. wide landscape strip are required between public

Following recent communications with the tenant and Planning Director, this office has made
the following determinations:
1. Allowed Use(s) at 7600 S. University Avenue, Suite 11, 12 and 14
The Planned Commercial Development (PCD) approved at 7600 S. University Ave. allows
50% of the entire building to be C-1 commercial uses, and 50% to be 0-1 office uses. This
use ratio is not your concern, but rather is the concern of the building owner/landlord.
An issue concerning your business is the prohibition of "events, "event space" or "event
facility" at 7600 S. University; "events" are prohibited uses at this development.
You recently explained to me your W. 40th St. location is one-half of your business where
party materials and clothes are stored, sorted and prepped. You explained your S. University
Ave. is the other half of your business, itself broken into 40% office/storage/display/sales and
60% multi-purpose studio space for children's music, dance, coloring, crafts and children's
arts, associated food consumption and related activities. These percentages convert overall
(both locations combined) to 70% office/storage/prep/display/sales, and 30% multi-purpose
studio activity space which is ancillary to the office/storage/prep/display/sales uses.
According to the Little Rock Municipal Code, permitted uses that are similar (but not
necessarily identical) to AC Children's Studio and Apparel* include book store, church,
clothing store, day care center, inside eating place, religious organization,
handicraft/ceramic/sculpture, hobby shop, lodge or fraternal organization, office, private
school, kindergarten, institution for special education, secondhand store, art/music/dance
studio, etc.
The overall 70% of your business related to office/storage/prep/display/sales is permissible as
C-1 uses. The 30% of your business that is multi-purpose studio activity space features
similar uses as those in the above paragraph. The uses in your studio space include music,
dance, painting and coloring, associated food consumption, and other supervised children's
activities and are permissible within the PCD at 7600 S. University Ave.
2. Business License(s)
Our records indicate you possess a valid business license (#BL159313) at 8224 W. 40th
Street, however, we find no record of a business license for your 7600 S. University site.
Immediately apply for business licenses at both addresses (and bear in mind "events" and/or
"event facility" or "event center" are not allowable uses within Planned Commercial
Development zoning at 7600 S. University Ave,)

A.) Our records also indicate your AC Events and Apparel sign does not have a valid permit,
which must be immediately remedied by calling our Zoning Desk (501)371-4844 to complete
an application for approval.
B.) The Little Rock Municipal Code prohibits wall signs and awning signs from extending
above the roof line. Your re -worded sign must be fastened to the awning, or otherwise
adjusted to conform with the Code requirement. (This office has notified the other businesses
in the building of these permitting requirements.)
C.) Also, the "AC EVENTS and Apparel" signs on your awning, as well as on your door, must
be changed to remove the word "EVENTS " because such uses are not permitted within the
Planned Commercial Development at 7600 S. University.
I SUMMARY
Proceed at 7600 S. University Ave. with uses generally limited to the following:
- Office/storage/display/sales and multi-purpose studio space for children's music,
dance, coloring, crafts and children's arts and related activities.
- Maximum of one (1) paid employee [in addition to business owner] if applicable.
- Maximum of thirty (30) participating children at any given time.
- Business hours are limited to daylight hours extending to 9pm on weekdays and
to 10pm on weekends.
- No alcohol sales.
Update your business licenses, sign design and permitting as described above.
Note: City of Little Rock remains obligated to respond to complaints of excessive
noise, light, trash or other pollution, as well as shortage of parking or overflow parking,
and may revoke the terms of this memo at any time.

the concern at issue which is AC Events � Apparel signage with Events being larger than Apparel. Let me
try to explain the nature of that part of the business and if you have any further concerns or questions
please feel free to give me a call.
I have had birthday parties in suite 11/12 for kids age ranging from 1-10 years old. The event is held
inside the building with approximately 25-30 guests if that many. The birthday party will have 6 balloon
columns setup, backdrop, about 4-6 tables setup with table cloths and plates, and 2 bounce houses no
larger that 8ft_ We do not have or serve alcoholic beverages at these events. There are no employees but
myself, my children will help me with setup and cleanup. My apparel is 75% of my business the events is
about 25%, majority of the customers that 1 cater to have a place for their events and I am hired to make
the t -shirts and party decorations. I do not have any event past the hour ofBpm even if that latea norma

out to; 1 of which is not opened yet and being remodeled inside. There is a dance studio that has curfew

Temple (shrine temple). The rear northern tract of the property is zoned as OS and the front southern
tract is zoned as 0-3. The next Z file (Z 3150-D) approves the amendment from 0-3 to PCD. There are
emails in this file from Dir. Adcock in 2018 regarding the same concerns we are discussing. A response
from Dana Carney to Dir. Adcock states "the temple is classified as a religious entity /church." There was
indication that they do not rent out their banquet halls to outside entities an that event are their own. It
is also mentioned that "they allow Central High School to use their facility 3-4 times per year for special
banquets. The county assessor also classifies them as a church and as a religious entity; they do not have
to have a business license."
9110 1-30 (441-2020100700) was Rodney's Cycle House which heard from co-workers there was a lot of
biker events going on. Currently this property is owned by DFA effective 12/29/2020.
If there are any events going on outside of working hours, Dir. Adcock would know more than I would in
that area. It is my opinion, that these locations are complying with the uses of C-1, 0-1, and 0-3. 1 did
not see any violations upon my inspection/investigation. If there is anything outside of working hours, I
would not know any violations as of this time and may need more proof if there are continued
concerns/issues around these parcels.

We would like to develope this property as a multi use
area of offices, wholesale and retail.
Sections A and B on the site plan will be wholesale and
retail. Speci f i cal y "we-r•equest zoning of section A for use
as an Automobile Paint and Body Shop Parts and Suppl-ies store
and or other uses as described under C-3 Zoning rules, and
section B for uses as described in C-3 Zoning rules. These
areas will have 8552 square feet.
Section C will have 7800 square feet, and be for offices.
We request this area be approved for general uses under the
0-1 office zonning rules.
The timetable for this project, is to start within 60 days,
and expected completion before end of this year, contengent on
