HomeMy WebLinkAbout15851 1 RESOLUTION NO. 15,851 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR AND THE CITY CLERK 4 TO EXECUTE A UTILITY EASEMENT FOR PROPERTY LOCATED AT 5 THE NORTHEAST CORNER OF KANIS ROAD AND EMBASSY DRIVE, 6 IN THE CITY OF LITTLE ROCK, ARKANSAS, TO ENTERGY 7 ARKANSAS, INC., FOR ELECTRIC POWER FACILITIES; AND FOR 8 OTHER PURPOSES. 9 10 WHEREAS,Entergy Arkansas, Inc., has requested and agreed to pay for a Utility Easement on City- 11 owned property at 11324 Kanis Road to locate overhead power facilities for the purpose of providing power 12 and communication services to other customers on Embassy Drive;this easement being necessary to avoid 13 exiting overhead traffic signal equipment. 14 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 15 OF LITTLE ROCK,ARKANSAS: 16 Section 1. The Mayor and City Clerk are hereby authorized to execute a Utility Easement,in the form 17 and final legal description which has been approved by the City Attorney,to grant a nonexclusive easement 18 in certain City property at the northeast corner of Kanis Road and Embassy Drive,as shown on the attached 19 Exhibit A,and as described herein,to Entergy Arkansas, Inc., for construction,operation and maintenance 20 of overhead electric power facilities. 21 Section 2. The easement property is more particularly described as follows: 22 Being a part of Lot 1 Pita Addition,to the City of Little Rock, Arkansas,also being a part 23 of the Southwest Quarter of the Southeast Quarter of Section 4,Township 1 North,Range 24 13 West, all being in Pulaski County, Arkansas, being more particularly described as 25 follows: commencing at the northwest corner of said Lot 1 of said Pita Addition, thence 26 along the north line of said Lot 1,South 87 deg.28 min. 58 sec. East for a distance of 18.61 27 feet to a point fifteen(15)feet east of the centerline of an Entergy distribution line;thence 28 leaving said north line,along a line 15 feet East and parallel to the centerline of said Entergy 29 distribution line, South 29 deg. 41 min. 43 sec. West for a distance of 245.00 feet; thence 30 continue along said parallel line, South 20 deg. 51 min. 17 sec. East for a distance of 58.29 31 feet to the north right-of-way of Kanis Road;thence along said right-of-way,North 86 deg. 32 54 min. 16 sec. West for a distance of 13.90 feet;thence continue along said right-of-way, 33 North 80 deg. 50 min. 10 sec. East for a distance of 77.92 feet and having a radius of 305.00 feet to the Point 10 of Beginning of the land herein described, containing 0.15 acres, more or less. 11 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 12 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 13 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 14 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 15 resolution. 16 Section 4. Repealer.
