PLANNING CONSIDERATIONS:
No adverse comments have been received from any reviewing
agency concerning this request. The applicant developed
both the apartments to the north and the commercial tract to
the east. He had reserved this tract for further commercial
development within his platting, but the zoning was not
committed from the City.
The "C-3" zone to the east was granted under the South
Central Island Zoning Plan which sought to recognize
existing businesses. The Majik Market was considered a
supporting neighborhood business appropriate to the area and
the adjacent developments and was zoned accordingly. The
skating center to the west was considered an anomaly in the
area and left nonconforming. Zoning this additional
property would surely begin the stripping out of Mabelvale
Cutoff between Geyer Springs and Chicot Roads.
STAFF RECOMMENDATION:
Staff recommends denial.

PLANNING COMMISSION ACTION:
The applicant was present. There were no objectors. After
a lengthy discussion in which the applicant stated that he
had purchased the property in 1969 and had recorded a plat
in 1971 which identified this property as having been set
aside for commercial use at the same time that it set aside
property for the existing Majik Market on the site as well
as the apartment project to the north. He stated that he
owned the 200 apartment units to the north as well as the 64
apartment units to the southeast. He stated that it was his
belief and his contention that the City had made a
commitment to commercial zoning when the plat was approved
showing commercial on the site. After a lengthy discussion,
the Commission moved to approve the application as filed.
The motion passed - 10 ayes, 0 noes and 1 absent.
