PLANNING CONSIDERATIONS:
Engineering states that the south 100 feet or so of this
property is within the floodway and floodplain which are
nearly the same line in this area. The Wastewater Utility
states that no sewer service is available to most of this
property. No other adverse comments were received.
Neighbors in this area have expressed considerable
opposition to the auto salvage business and were
instrumental in bringing enforcement action on this property
which resulted in this application. Staff understands that
the owner purchased this property after having been told by
the seller that it was not in the City of Little Rock.
However, staff cannot support heavy industrial zoning on
this property.
STAFF RECOMMENDATION:
Staff recommends denial.

PLANNING COMMISSION ACTION:
The applicant was present, and there were 41 objectors
present. The applicants were represented by Carolyn Fuller,
attorney, who stated that she had sworn statements from
previous owners that a small salvage yard operation had been
located on the property by a prior lessee. She stated that
the applicants had been told by both the owner of the
property and the Little Rock Abstract Company that the
property was not in the City as late as the day of the
closing on the property. They presented a petition from
patrons of the salvage yard favoring the keeping of the
operation at this site and stated that a privacy fence would
be erected.
Bob Fulmer, representing residents of the area and not
members of the Geyer Springs Baptist Church, stated that the
operation had begun on January 3, 1983, without any kind of
permits. He presented a petition disputing the claims that
a prior auto salvage use had been there. The petition had
approximately 140 signatures. He spoke for some time about
the history of the property and the area. He showed a map
of existing salvage yards within a several mile vicinity of
the site in question and stated that his neighborhood did
not need another salvage yard. He showed photographs of the
existing yard at the subject property as well as other
salvage yards around so that the Planning Commission would
see the kind of problems that exist and, finally, presented
a petition from the neighbors requesting denial of the
application. This petition had over a 100 signatures. A
second opponent, Rev. Roy Dale Clark, Geyer Springs Baptist
Church, spoke on behalf of the church membership. He stated
that approval of the zoning for this property would
adversely impact the future use of other vacant properties
in the area.
Having heard the opposition and seen the number of folks who
had turned out, Ms. Fuller stated that the applicants, in
view of all the opposition, would like to amend the request
for zoning from a request for "I-3" Heavy Industrial to a
request for "R-7" Mobile Home Park District. The Commission
asked staff if it was prepared to respond to such a request.
The staff stated that it would prefer deferral to the
June 28th meeting for the purpose of allowing the various
utilities and engineering to review the request on that
subject. The Commission moved to defer the item to June
28th. The motion passed - 10 ayes, 0 noes and 1 absent.
