A. Public Works Issues:
1. Comply with conditions in Public Works minute:record
of November 1997.
B. i Staff Analvsis:
CalArk Trucking Company is located at 12024 I-30; a 30±
acre, C-4 zoned tract bounded by Otter Creek Road on
the north and I-30 on the southeast. The trucking
company is located on the western 22± acres of the
tract. On November 24, 1997, the Board of Adjustment
granted a two-year deferral of the paving requirements
of Section 36-508, allowing the trucking company to
utilize a gravel parking area for the company's trucks
and employee vehicles. There was some question, at
that time, of a possible realignment of the Otter Creek
Road overpass over I-30 which could have affected this
site. That two-year deferral expired on November 24,
1999.
On November 11, 1999, the Planning Commission approved
a preliminary plat, dividing the easternmost 8± acres
of the site into 4 lots which were to be sold for
potential development by other parties. CalArk stated
it was uncertain how the truck terminal facility would

Staff Analysis:
Cal Ark Trucking occupies the C-4 zoned property located at
12024 I-30. The property is located at the I-30/Otter Creek
Interchange. Cal Ark is requesting a 24 month deferral of
the paving requirement of Section 36-508 to allow continued
use of a gravel parking area.
Cal Ark intends to fully comply with the City's paving
requirements. They cannot however make long-term plans for
the use of the property until the Arkansas Highway
Department has decided on a definite design for a new I-
30/Otter Creek Interchange. It is possible that a
substantial portion of this site will be absorbed into the
new interchange for access roads and exit/entrance ramps.
An aerial photograph has been submitted by the applicant
showing the potential road alignment.
Staff believes it is reasonable to grant the 24 month
deferral. The site has had some unimproved area used as
truck parking since before it was annexed into the City.
The potential is there for the applicant to construct an
expensive paved and landscaped parking area only to have it
destroyed by realignment of the interchange.
Staff Recommendation:
Staff recommends approval of the 24 month deferral of the
paving requirements of Section 36-508 subject to compliance
with Public Works Comments.

Staff Report:

On January 31, 2000, the Board approved an additional deferral,
through November 24, 2000. Although staff supported the
additional 12 months, it was clear that the support was only for
a deferral through November 24, 2000. The applicant is now
requesting an additional 12 months deferral of the paving
requirement. The justification offered by the applicant is the
same as previously offered; it is uncertain how the property will
"layout" for a truck terminal once the easternmost portion is
developed into the previously approved 4 lot subdivision.

Staff is not supportive of an additional deferral. Staff
questions whether any steps have been taken toward development of
the 4 -lot subdivision which is being touted as justification for
the deferral. At some point, a decision must be made and the
site developed to comply with City Code. It may very well be
that the preliminary plat that was approved on November 11, 1999
has expired. Section 31-94(e) of the Subdivision Ordinance
states:
(e) A preliminary plat approved by the planning
commission shall be effective and binding upon the
commission for one (1) year from the date of
approval or as long as work is actively progressing,
at the end of which time the final plat application
for the subdivision must have been submitted to the
planning staff. Any plat not receiving final
approval within the period of time set forth herein
or otherwise conforming to the requirements of this
chapter shall be null and void, and the developer
shall be required to submit a new plat of the
property for preliminary approval subject to all
zoning restrictions and this chapter.
C. Staff Recommendation:
Staff does not recommend approval of the requested 12 -month
extension of the previously granted deferrals of the paving
requirement of Section 36-508.
BOARD OF ADJUSTMENT:
(JANUARY 29, 2001)
The applicant, Chuck Reimer, was present. Staff presented the
item.
Mr. Reimer addressed the Board in support of his request. He
stated there had been some interest in the 4 lots, but nothing
definite. Mr. Reimer stated that he had spoken with Arkansas
Highway and Transportation Department representatives and, due to
the pending change to one-way traffic for access roads, the issue
of a possible realignment of the Otter Creek overpass had
resurfaced.
In response to a question from Fred Gray, Mr. Reimer stated that
the 4 lots were listed with the Hathaway Group realtors. He
stated the lots were well -signed and had been actively marketed.
Mr. Reimer stated he would like to see how the 4 retail lots

develop prior to finalizing plans for the truck terminal so that
truck traffic did not interfere with the retail traffic. Mr.
Reimer reiterated that there was still uncertainty about the
status of the Otter Creek overpass. He stated he had no idea why
AHTD was taking so long to make a determination about the
overpass.
At the request of the Board, Mr. Reimer approached and showed the
location of the 4 lots in relationship to the truck facility.
Norm Floyd questioned whether the site was in the floodway.
Staff responded that the truck parking area in question was in
the floodplain, not the floodway.
Scott Richburg asked if AHTD had given any indication of when a
decision would be made regarding the overpass. Mr. Reimer
responded that he had not been told of any time frame. Mr.
Richburg commented that it could take months for a decision to be
made and years for the lots to be sold and developed-. Mr.
Richburg stated that, at some point, the site needed to be
properly developed.
Fred Gray stated that he perceived Mr. Reimer's concern being
that he did not want to pave the site and then have somebody
purchase a lot or lots. He asked Mr. Reimer if the 4 -lot area
was not actually needed for the truck terminal since the plan was
to sell that portion of the site. Mr. Reimer agreed with Mr.
Gray's assessment.
Norm Floyd asked if there was no plan for expanding the terminal.
Mr. Reimer responded that there were no plans to expand the
terminal itself.
Fred Gray asked if it would take the sale of one lot or all 4
lots for the truck terminal plans to be finalized. Mr. Reimer
responded that it would require the sale of all 4 lots to assure
that there would be no conflict between the activities.
Norm Floyd asked if there was not some reasonable boundary that
could be established and developed for the truck terminal use.
Mr. Reimer responded that it depended upon the potential users of
the retail lots; that the lot sizes could change and could
involve expanding further onto the truck terminal site.
Norm Floyd commented that Cal Ark Trucking was an asset to the
City but that the gravel lot was creating a problem. He stated

he was in favor of an additional year deferral but would like to
see some good faith effort on Cal Ark's part.
Gary Langlais commented that waiting on the 4 lots to sell and
develop could take years.
William Ruck commented that he was familiar with AHTD's plans for
the interchange and how those plans had "bounced around". He
stated he was in favor of granting one more year to see what AHTD
has "up its sleeve".
Fred Gray asked if it was possible to grant an extension and to
make a definitive statement that it would be the last deferral.
Staff responded that such a statement could be made part of the
record and would be considered by the Board in any further
requests for deferrals.
Fred Gray asked Mr. Reimer if 12 months was a "magic number".
Mr. Reimer responded that it was not. Mr. Gray asked if it would
be inconvenient to return to the Board in 6 months for an update.
Norm Floyd commented that he had seen AHTD's plans for widening
I-30 and that he did not expect there would be any definite
actions taken within 6 months.
Scott Richburg stated he wanted to go on record as supporting the
deferral due to questions about the plans for I-30 and the
overpass, not due to issues about the sale of the 4 lots.
A motion was made to approve an additional deferral, through
January 30, 2002. The motion was approved by a vote of 5 ayes,
0 noes and 0 absent.

March 25, 2003. Staff did not support the additional deferral request. The
justification offered by the applicant related to the current financial situation of

the trucking company. A condition of the approval was that the applicant
appear at the September 2002 Board of Adjustment hearing and provide a
status/progress report regarding the paving issue. A copy of the March 25, 2002
Board of Adjustment minute record is attached for Board review.
BOARD OF ADJUSTMENT:
(SEPTEMBER 30, 2002)
Bill Hope, of Hope Engineers, was present, representing CalArk Trucking. Staff
briefly introduced the item. Mr. Hope gave a brief history of the paving issue.
Mr. Hope noted that the vehicular use area would be covered with a recycled
asphalt material. Mr. Hope stated that he felt sure that the paving would be
accomplished by the March 25, 2003 deadline, and explained. He explained
what portion of the property would be paved.
There was a lengthy discussion regarding the type of material proposed to be
used for paving the parking lot. Staff noted uncertainty as to whether the
material proposed for the paving conformed to ordinance standards. The paving
requirements found in Section 36-508 of the City's Zoning Ordinance were read
and discussed.
Andrew Francis stated that another variance may need to be filed by the
applicant if the proposed paving materials do not conform to ordinance
standards. He noted that the Board could not address a variance at this
meeting. This issue was discussed further.
Vice -Chairman Gray stated that he wished to see the site paved by March 2003.
The issue involving the type of paving materials to be used was discussed
further. Cindy Dawson, City Attorney, stated that the applicant needed to meet
with staff and determine if the type of paving materials proposed met ordinance
standards. She stated that the paving of the parking lot would have to conform
to the City's Zoning and Landscape Ordinances.
Scott Richburg also noted that he wished to see the site paved by March 2003.
There being no further issues for discussion, the presentation was adjourned.

Staff feels that the applicant has had ample time to
plan for the pavement of the parking area. This
property has over 2,100 linear feet of frontage along
Interstate 30, one of the main entries into the City of
Little Rock. Staff feels that it is time that the site
be paved and landscaped as per city code requirements,
in order to improve the property's appearance.
C. Staff Recommendation:
Staff does not recommend approval of the requested 12 -
month extension of the previously granted deferrals of
the paving requirement of Section 36-508.

Rochelle Gorman was present, representing the application.
There were no persons present in opposition. Staff
presented the item with a recommendation of denial.
Rochelle Gorman addressed the Board in support of the
requested paving extension. She gave a brief history of the
Property, including the past extensions granted. She noted
that pavement for tractor/trailer trucks had to be thicker
than standard parking lots because of the weight. She noted
that the cost to pave the parking area was estimated at
$500,000. She offered the current financial status of the
business as a reason for the additional deferral. She
stated that her company wanted to do the paving, but that
money was not currently available.
Vice -Chairman Gray stated that he felt the economy would
Positively affect the trucking business in the near future,
based on the information he had seen. He asked the
applicant about this issue. The issue was briefly di

Vice -Chairman Gray noted that the corner tract of this
Property was for sale and briefly discussed this property
with relation to other properties in the area.
Andrew Francis asked when the exit ramp for I-30 would be
completed. Ms. Gorman stated that she did not know.
Chairman Ruck asked if the new plan for the I-30 overpass
required Otter Creek Road to be realigned. Mike Hood, of
Public Works, stated that he did not know to what extent the
road would be realigned.
Staff asked what preparations the applicant had made during -
the past five (5) years for the paving. Ms. Gorman noted-
that the sale of part of the property would help finance the
paving.
Andrew Francis asked about the I-30 exit ramp and the
realignment of Otter Creek Road. This issue was briefly
discussed.
Also discussed were issues related to the previous
extensions.

Chairman Ruck stated that he had no problem with another
extension, given the status of other properties in the area.

Andrew Francis asked if there had been any complaints about
the property related to safety issues. Staff stated that
there had been none.
A motion was made to approve an extension for 12 months from
this date. Dana Carney, of the Planning Staff, suggested a
condition that would require CalArk to give the Board a
Progress report in six (6) months.
The motion was amended, adding the.requirement that the
applicant appear at the September 2002 Board of Adjustment
meeting and provide the Board with a status report. The
motion passed by a vote of 5 ayes and 0 nays. The time
extension was approved.

Although staff is anxious to see CalArk's property properly
developed with required paving and landscaping, it does not
appear that allowing some additional time is unreasonable. The
site has a long history of some use of unimproved vehicular use
areas. There are no other uses immediately adjacent to the site
which could be impacted by the time extension. Staff believes it
is appropriate to limit the extension to run until November 24,
20001 12 months from the expiration of the previous deferral.

Staff Recommendation:
Staff recommends approval of a 12 month extension of the
previously granted 24 month deferral of the paving requirements
of Section 36-508 subject to compliance with the following
conditions:
1. Compliance with Public Works Comments as outlined in the
November 24, 1997 minutes of case no. Z -3915-B.
2. The extension is to run only until November 24, 2000.
3. By November 24, 2000, the property is to be paved and
landscaped to comply with applicable city codes or use of the
unpaved area is to cease.

STAFF REPORT
A. Public Works Issues:
1. Comply with conditions in Public Works minute record
of November 1997.
B. Staff Analysis:
CalArk Trucking Company is located at 12024 I-30; a 30±
acre, C-4 zoned tract bounded by Otter Creek Road on
the north and I-30 on the southeast. The trucking
company is located on the western 22± acres of the
tract. On November 24, 1997, the Board of Adjustment
granted a two-year deferral of the paving requirements
of Section 36-508, allowing the trucking company to
utilize a gravel parking area for the company's trucks
and employee vehicles. There was some question, at
that time, of a possible realignment of the Otter Creek
Road overpass over I-30 which could have affected this
site. That two-year deferral expired on November 24,
1999.
On November 11, 1999, the Planning Commission approved
a preliminary plat, dividing the easternmost 8± acres
of the site into 4 lots which were to be sold for
potential development by other parties. CalArk stated
it was uncertain how the truck terminal facility would

be "laid out" on the remaining property. It appeared
that the possible realignment of the overpass was no
longer an issue. The 4 -lot plat was approved without
the realignment issue being of concern, other than for
some specific driveway placement.
On January 31, 2000, the Board approved an additional
deferral, through November 24, 2000. Although staff
supported the additional 12 months, it was clear that
the support was only for a deferral through November
24, 2000.
On January 29, 2001, the Board approved an additional
deferral, through January 30, 2002. Staff did not
support the deferral request, noting that the 4 -lot
preliminary plat (which was the basis of the last
deferral) had expired. Staff also noted that at some
point, the site must be developed to city code.
The applicant is now requesting an additional 12 -month
deferral of the paving requirement. The justification
offered by the applicant relates to the current
financial situation of the trucking company. Please
see the attached letter from Rochelle Gorman of CalArk
for additional details.
Staff is not supportive of an additional deferral.
Staff feels that the applicant has had ample time to
plan for the pavement of the parking area. This
property has over 2,100 linear feet of frontage along
Interstate 30, one of the main entries into the City of
Little Rock. Staff feels that it is time that the site
be paved and landscaped as per city code requirements,
in order to improve the property's appearance.
C. Staff Recommendation:
Staff does not recommend approval of the requested 12 -
month extension of the previously granted deferrals of
the paving requirement of Section 36-508.

BOARD OF ADJUSTMENT:
(MARCH 25, 2002)
Rochelle Gorman was present, representing the application.
There were no persons present in opposition. Staff
presented the item with a recommendation of denial.
Rochelle Gorman addressed the Board in support of the
requested paving extension. She gave a brief history of the
property, including the past extensions granted. She noted
that pavement for tractor/trailer trucks had to be thicker
than standard parking lots because of the weight. She noted
that the cost to pave the parking area was estimated at
$500,000. She offered the current financial status of the
business as a reason for the additional deferral. She
stated that her company wanted to do the paving, but that
money was not currently available.
Vice -Chairman Gray stated that he felt the economy would
positively affect the trucking business in the near future,
based on the information he had seen. He asked the
applicant about this issue. The issue was briefly discussed
by the applicant.
Vice -Chairman Gray noted that the corner tract of this
property was for sale and briefly discussed this property
with relation to other properties in the area.
Andrew Francis asked when the exit ramp for I-30 would be
completed. Ms. Gorman stated that she did not know.
Chairman Ruck asked if the new plan for the I-30 overpass
required Otter Creek Road to be realigned. Mike Hood, of
Public Works, stated that he did not know to what extent the
road would be realigned.
Staff asked what preparations the applicant had made during
the past five (5) years for the paving. Ms. Gorman noted
that the sale of part of the property would help finance the
paving.
Andrew Francis asked about the I-30 exit ramp and the
realignment of Otter Creek Road. This issue was briefly
discussed.
Also discussed were issues related to the previous
extensions.

Chairman Ruck stated that he had no problem with another
extension, given the status of other properties in the area.
This issue was briefly discussed.
Andrew Francis asked if there had been any complaints about
the property related to safety issues. Staff stated that
there had been none.
A motion was made to approve an extension for 12 months from
this date. Dana Carney, of the Planning Staff, suggested a
condition that would require CalArk to give the Board a
progress report in six (6) months.
The motion was amended, adding the, requirement that the
applicant appear at the September 2002 Board of Adjustment
meeting and provide the Board with a status report. The
motion passed by a vote of 5 ayes and 0 nays. The time
extension was approved.
