Kay Rogers Smith Asbury Park Apartments Rezone from "MF -24" Multifamily to "MF -12" Multifamily Conformity with Planning Commission Requirement 10 acres + Existing Use: Apartments (under construction) SURROUNDING LAND USE AND ZONING: North - Vacant, Zoned "C-3" South - Residential, Zoned "R-2" East - Vacant, Zoned "R-2" West - Vacant, Zoned "O-3" and "R-2" PLANNING CONSIDERATIONS: No adverse comments have been received from any reviewing agency concerning this request. This application was made for the purpose of complying with the Planning Commission requirement that the zoning be amended to conform with the "as built" density of the project. STAFF RECOMMENDATION: Staff recommends approval. COMMISSION ACTION: The applicant was present, and Effie Bowers, representing the Brownwood Terrace Property Owners Association, was present and asked for deferral of this matter. The Commission moved to defer this matter to the November 9 Planning Commission meeting. The motion failed for a lack of a second. The Commission then moved to approve the application as filed, and the motion passed: 9 ayes, 0 noes and 2 absent. October 26, 1982 Item No. 7 - Continued In addition, relative to this matter, the Commission confirmed its Resolution No. 27 dealing with the Michael Drive street improvements and the certificate of occupancy on the Asbury Park Apartments. After some discussion with Bob Richardson, an enginner representing Kelton Brown and the developers of Asbury Park Apartments, the Commission stated that its intention in the Resolution was to withhold the certificate of occupancy for the apartment project until Michael Drive had been constructed from its present northern terminus in Brownwood Terrace Subdivision to Kanis Road. A motion clarifying this point was passed: 9 ayes, 0 noes and 2 absent.
