Allow me to list high-level people and groups not having any luck lately fighting_ City Hall in Little Rock Pulaski County- Judge Buddy Villins. Pulaski County Prosecutor Larry Jegley. Pulaski County As- sessor Janet Ward. The Downtown Partnership that advocates for growth downtown. The Quapaw Quarter As- sociation that advocates for historic preservation in the original city. For that shatter, we can add the employees on the professional staff of City Hail's own Planning Department. They got overruled last week by the citizen-eomposed Planning Com- mission. What all these people and groups opposed—for transcendentally log- ical reasons—was the erection of a 24-hour, seven-day Mapco Express gas station and conve- nience market and din- ing outlet. The location? That would be Third and Broadway, square -dab in downtown Little Rock, where fuel islands and a mar- ket and eatery would replace a vacant bank building and old parking garage. The site is across the street from county government's administrative offices. It's across another street from the prosecutor's offices. It's a couple of blocks from the county courthouse itself, not to men- tion City Hall and the Robinson Cen- a few blocks are federal government offices. It's a place of rush-hour bedlam already, bustling with heavy vehicular and foot traffic. Pedestrians occasion- ally have been struck by cars. Cars fre- quently have crashed into each other. And now the Planning Commis- sion, by a vote of 7 -to -2, has said we should put gas pump islands on this site, along with a place to pick up bread and milk and sit down for a lunch, dinner or breakfast of whatever Mapco serves. And the Planning Commission seems to think left turns across traffic to new curb cuts off Third Street and off Broadway would represent a fine addi- tion to the downtown rush-hour vehicular dynamic. Left turns are re- stricted at the inter- section itself during rush hours. So let's add new unrestricted left turns in midblock. Isn't that nuts? That's what I asked the city planning director, Tony Bozynski, and an assistant who was on the speaker phone with us. I heard laughter. Bozynski said the planning staff' had recommended against approval for those very kinds of concerns. But acceding to overwhelming community and official opposition would not amount to an arbitrary action. As Villines pointed out, dedir ing to restrict zoning and planning for fear of legal retribution would mean doing away with zoning and planning. Here's how the Planning Cominis- sion voted: "Yes" votes were cast by Keith Fountain, Janet Dillon, Bill May, Thomas Brock, Alan Bubbus, Buelah Bynum and Keith Cox The sensible and responsible votes, by which I mean the "no" ones, were cast by Jennifer Belt and Rebec- ca Finney. It all goes now to the City Board of Directors, perhaps in June. The board will receive both the planning staffs recommendation of rejection, and the planning commission's recommenda- tion of approval. Mapco Express Mart wants to build a gas station at the northwest corner of P and Broadway. Some time ago, a majority of the Downtown Little Rock Partnership Board of Directors voted to oppose the change in zoning at Broadway and Markham for Mapco from its present Urban Use (UU) designation to Planned Development -Commercial. The DLRP supports a downtown where we can "live work play invest." We want jobs. We want a safe environment for those who live, work and play downtown. We do not oppose Mapco. We oppose this use for the Broadway and Markham location for the following reasons: 1. UU zoning was designed to support downtown development by helping create a compact, dense (populated) and distinguishable core area for office, civic and business use. 2. Mapco is requesting major variances to the UU zoning. Buildings should be oriented to the street. Mapco's will be set back. Parking should be behind or adjacent to a structure with all uses enclosed or inside except for outside dining. 3. Approval will set a dangerous precedent and open the door for like uses (e.g., additional convenience stores with fuel pumps) in our urban core. 4. A sprawling service station in this space, taking up a half block east to west on Markham, is an inappropriate use in the context of the civic investment that is neighboring the site. 5. We are about to embark on major renovations of Robinson Auditorium and the Broadway Bridge, two blocks away from the proposed Mapco, that will support the draw of more visitors, an area where pedestrian safety is already a major concern. Approval of zoning changes here is inconsistent with the development that is occurring in the nearby Creative Corridor, and the undeniable momentum in the redevelopment and revitalization of downtown that supports our pedestrian -friendly goals. We need your help on Tuesday, July 1. Come to the City Board meeting and express your opposition to this zoning application. Through our many public and private listening sessions with you, the Directors and other prominent citizens and associations concerned with the well-being of the downtown community, we have heard several recurring concerns and want to address them prior to our presentation and Board vote scheduled for July 1, 2014. 1) Security ■ Our proposed project involves removing two dark, vacant buildings with poorly lit underground parking and two billboards and replacing them with an attractive, modern and inviting convenience store. • The entire premises will be brightly lit with dark sky compliant LED lighting from dusk to dawn. • A full complement of digital security cameras (15+) will be installed inside and outside the store. • The store register is limited to a maximum of $50 at all times. • We intend to provide "double coverage" staffing during overnight hours 2) Single Serve Beer Sales • We will voluntarily remove all 32 & 40 ounce single serve beer bottles and cans from our present merchandise offering. 3) Traffic Our development calls for eliminating four of the current eight curb cuts at the site, thereby reducing the number of potential entry/exit points by 50%. Being a "convenience" business rather than a "destination" business, we draw customers from existing traffic, rather than generating new traffic. Independent traffic studies around the country have confirmed this and we are forecasting very limited traffic increase. 4) Landscaping • We have reinforced our initial landscaping plan to a plan that exceeds the city's requirements. • We have eliminated a parking space at the intersection of 3rd & Arch Streets as part of the plan to anchor both corners of our development with attractive landscaping elements. We look forward to our building being an architecturally pleasing addition to the area. • Our store will not visible from the Robinson Center, the Courthouse, City Hall or other important landmarks, despite allegations to the contrary. • Our adjacent uses consist of multiple surface parking lots, an Enterprise Car Rental business, a municipal garage, an automotive body shop and the County Administration building. All adjacent property owners have sent letters of support for our project. We look forward to being an active part of the downtown Little Rock community and to sponsoring pro- growth activities involving the Downtown Little Rock Partnership and the entire business community. We have listened to the community's concerns and have modified our building and operational plans (within the constraints of our economic model) with the adjustments outlined above. Gazette owner J. N. Heiskell, the Chair of the Planning Commission, wanted the City to purchase the land west of Broadway from 2nd to Capitol to create a public building cluster. A disciple of John Nolen and other early urban planners, Mr. Heiskell was very much a visionary. (Even though the John Nolan plans were never enacted, Mr. Heiskell would refer to them up through the 1950s. Once he even called Mr. Nolen to get him to weigh-in on whether a City Council action would be counter to what Nolan had suggested.) Though he didn't get his 1929 plan adopted, Mr. Heiskell used the same arguments about the value of a public building cluster in the discussion about the location for a municipal auditorium in 1937. He was the person most responsible for the selection of the current site of Robinson Auditorium. He kept using arguments of the value of urban planning until he wore down the City Council and they selected the site he wanted. His choice for location turned out to be the best— not only at the time but it allowed for future growth. N. Heiskell resurrected the John Nolen plan for a downtown civic center which would include an auditorium. As chairman of the City Planning Commission, Mr. Heiskell proposed that the City of Little Rock purchase three blocks of land due south of City Hall for the creation of a public space and future site for a municipal auditorium. At this point in time the federal government was seeking a site for a new post office and federal office building in downtown Little Rock. In a series of meetings, members of the City Planning Commission, City Council, Chamber of Commerce and other interested parties met to discuss this possibility in March 1929. The issue was first broached at a special meeting on Thursday, March 21 where Mr. Heiskell laid out the concept. At that meeting, it was decided there would be further discussion on the following Monday) As he had so often on many other issues of civic virtue (especially those with which he was associated), Mr. Heiskell used the pages of the Gazette to elucidate on the value of the proposal. There were articles in the paper on March 22, 24, 25 and 26. Sunday the 24th, in fact, featured an article, a guest column and an editorial all dedicated to the virtues of the proposal. During the same time period, the rival Democrat carried no mention of the proposal or the meetings. On Saturday, March 23, Little Rock realtor M. E. McCoy addressed the Little Rock Engineers Club on the topic of the civic center concept. He stated that it would be impressive for visitors to the city. Not limiting his remarks to the need for civic pride downtown, he also discussed the need to create parks in neighborhoods." The text of Mr. McCoy's remarks was printed in the Gazette a few pages before an article about his speech. In his comments Mr. McCoy declared "In the civic center matter, Little Rock is face to face with monumental achievement or blunder." He further described that with the federal government seeking a site for a new post office, this was an opportunity to create a civic center which would not only feature local government buildings but also other public structures. Mr. McCoy cited Mr. Heiskell's vision for the government buildings and an "auditorium, museum, library and other public memorials grouped on adequate adjacent and near -by sites." He also averred that there could be "no doubt about the need" for the civic center and the accompanying accoutrements. Mr. McCoy concluded by stating that he expected the forthcoming special meeting to come up with plans on how to accomplish this task and encouraged Little Rock voters to support proposals which would emerge."' An editorial in the Gazette the same day drew parallels between activities in Washington DC and the potential for Little Rock. The piece noted that several new federal buildings were being constructed in the nation's capital which would be clustered around two different expanses of greenspace. These were, the editorial offered, a model for Little Rock to copy. The editorial then repeated Mr. Heiskell's proposal. It did not go into the details which Mr. McCoy had in his speech, but did suggest that the block bounded by 3rd, Broadway, 4th and Arch Streets would be the ideal spot for a civic auditorium.'`' The follow up meeting took place on Monday, March 25.° It included members of the City Planning Commission, City Council, Little Rock Real Estate Board and Chamber of Commerce. Because it was not a formal meeting of the City Council, no official minutes of either the March 25 or the earlier March 21 discussion exist. But obviously Mr. Heiskell's and Mr. McCoy's enthusiasm were not shared by all attendees. The very brief follow-up article buried deep in the next day's newspaper noted that the discussion went on "at length." In the end, instead of creating a formal plan for acquiring the land, the attendees decided to create a prospectus which could be submitted to the City Council.`'' Much like the aborted auditorium discussions from 1919 through 1922, no mention of this prospectus ever appears in City Council records. Given previous and subsequent comments about auditorium proposals, it is likely that the question of financing the civic center plan was once again a stumbling block. Given that the conversation took place at a time of transition in the office of the Mayor as well as City Attorney and the City Council, it also seems to have been a victim of timing. In the Gazette's coverage, no City Council member ever was quoted as advocating for the proposal, so there also seemed to be a lack of political will to push it forward. Both Existing Structures and Permissible Uses have an issue with the use because of the proximity to the Pulaski County properties, City Hall, a renovated Robinson Auditorium and a new Broadway (America's ) Bridge. A concern that it will affect the value of the public investment and because of their intent to sell single serve beer. We feel that this is not the best use of the property in question. We are a fairly new group working to ensure the great strides Little Rock has made in making downtown Little Rock a world class destination continue. It has recently been brought to our attention that there are attempts to bring plans for a 24- hour service station and convenience store at the corner of P and Broadway before the Little Rock Planning Commission. This section of downtown has already been listed as one of the most dangerous intersections for pedestrians and bicyclists in all of Little Rock and it's an area with tremendous traffic flow that will be further disrupted by a service station on a corner that is gridlocked during most hours of the day. Not to mention city voters recently approved a $70 million renovation to Robinson Auditorium less than two blocks from this location to enhance the appeal of downtown and bring in world-class performing arts events. The increased traffic, coupled with already unsafe pedestrian conditions that are sure to be exasperated, and the added complications for having to rezone the area to allow for the gas station, should all be considered. Especially considering its location across from a $70 million taxpayer funded renovation designed to enhance Little Rock's appeal and draw folks into downtown. This is not the Smart Growth and forward thinking we have worked towards to enhance the safety and quality of life for Little Rock residents and visitors. If we truly want to invest in, and continue to build our city into a world class, pedestrian friendly destination by enhancing our taxpayer investments; this is not the way we should go about planning for our future. The UU, Urban Use Zoning District was created to allow for developments within the Urban Use District to provide multiple uses within the same structure and encourage the ground or street level of the structure to include street oriented activity and pedestrian amenities. Staff feels this development is not in keeping with the intent of the UU, Urban Use Zoning District. The building has been pushed back from the primary streets and there are paved areas and driveways between the proposed building and patio area. In addition the fuel canopy is located along West 3rd Street which is considered a primary street. Parking is located within the front setback and driveways are located inconsistent with the typical ordinance standard. In addition staff has concerns with stacking on the site and access to the site for service vehicles including the fuel truck and garbage collection vehicle. Staff does not feel there is adequate circulation on the site to not disrupt traffic flows on the abutting streets. I. STAFF RECOMMENDATION: Staff recommends denial of the request. BACKGROUND The property is located at the northwest corner of 3`d and Broadway Streets. The project will encompass the southern half of Block 119 Original City of Little Rock and extend west to S. Arch Street. The construction includes a 4,780 square foot convenience store and outdoor patio and the placement of a fueling canopy and gas pumps on the site. Seven (7) fueling stations with underground storage tanks are indicated on the site plan. The existing improvements on the site will be removed to allow the new development. The existing driveway on Broadway is shared with the development to the north and will remain in place and continue to be shared. The existing driveway on South Arch Street will remain as access to the site. The dumpster will be screened as required by ordinance. Currently there are five (5) driveways along 3`d Street. The developer is proposing to eliminate the five (5) existing driveways and construct two (2) new driveways which will provide adequate access to the proposed convenience store. This will require a variance which the developer is requesting. Staff is not supportive of the request. The W, Urban Use Zoning District was created to allow for developments within the Urban Use District to provide multiple uses within the same structure and encourage the ground or street level of the structure to include street oriented activity and pedestrian amenities. Staff feels this development is not in keeping with the intent of the UU, Urban Use Zoning District. The building has been pushed back from the primary streets and there are paved areas and driveways between the proposed building and patio area. In addition the fuel canopy is located along West 3`d Street which is considered a primary street. Parking is located within the front setback and driveways are located inconsistent with the typical ordinance standard. In addition staff has concerns with stacking on the site and access to the site for service vehicles including the fuel truck and garbage collection vehicle. Staff does not feel there is adequate circulation on the site to not disrupt traffic flows on the abutting streets. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from UU, Urban Use District to PD -C: Lots 4 — 9, Block 119, Original City of Little Rock, Pulaski County, Arkansas. SECTION 2. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 3. That the change in zoning classification contemplated for Mapco Express Short -form PD -C (Z -3922-A), located on the Northwest corner of 3rd and Broadway Streets is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances. SECTION 4. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
