PLANNING CONSIDERATIONS:
No adverse comments have been received from any reviewing
agency concerning this request. Right-of-way will be
required on Baseline Road. The property is presently
occupied by a nonconforming mobile home sales lot which
also covers the property to the west... The owner intends to
plat the property into two lots and sell this'part to
another user.
The Suburban Development Plan shows commercial uses near the
intersections of Baseline and Chicot Roads and Baseline and
Geyer Springs Roads, and those areas are zoned for
commercial use. When this area was annexed, there were a
number of nonconforming commercial and industrial uses which
were taken in without the proper zoning. This was done
because they were located in areas which were not
appropriate to such uses. Staff is concerned that Baseline
could be become one long commercial strip if this and others
like it were zoned one at a time.
STAFF RECOMMENDATION:
Staff recommends denial.

COMMISSION ACTION: (9-28-82)
The applicant was present, and there were no objectors. The
applicant showed pictures of the area and a map of zoning
and land use, as well as a site plan proposed for the store
being proposed. Ronnie Caveness, owner of Smackey's
Doughnut Stores, discussed why he had chosen this site and
talked about his various locational requirements, as well as
building requirements. A neighbor, Hank Kelly, spoke for
the application. The applicant emphasized that the property
had been platted originally and was recorded as Kerr
Commercial Plat, and that plans ultimately are to redevelop
the entire tract. He stated that presently there is a
mobile home sales lot on the property with approximately
twelve to fifteen mobile homes on display and that there are
twenty-six mobile homes in the park to the south. Another
neighbor on the opposite side of Baseline voiced his support
for the application.
After a lengthy discussion, there was a motion to defer this
item to the October 12 meeting to allow time for staff to
review the Baseline corridor between Chicot and Geyer
Springs Roads. The motion to defer passed: 6 ayes and
5 noes.
COMMISSION ACTION: (10-12-82)
Jim Lawson, of the Planning Staff, showed snaps of the
existing land use and future land use plan along the
Baseline corridor and discussed the issues involved. The
plan maps suggest office use for the property in question in
this application. After this discussion, the applicant
talked about the potential for office use of the properties
along Baseline Road and said, in his professional
estimation, that there was no way that offices would be
developed along Baseline because of its high traffic use and
the potential for it being developed to a wider street
standard, thereby making it more suitable for commercial use
and less suitable for office use. He cited also the nature
of the frontage which had only a few parcels large enough
for office construction.
The Planning Commission recognized that the "0-3" District
permits a restaurant as a conditional use, and there was a
lengthy discussion of the potential of zoning this property
"0-3" General Office and then in attaining an application
for a conditional use permit to allow the restaurant at this
location, that is, to permit a restaurant without zoning the
property commercial. The applicant and the buyer of the
property asked a number of questions of the Planning

Commission members and staff, and finally it was determined
that the applicant would amend the application to request
"0-3" General Office, rather than the "C-3" General
Commercial initially applied for. On this basis, the
Planning Commission moved to approve "0-3" on the property,
and the motion passed: 8 ayes, 1 no and 2 absent.
The applicant plans to submit a conditional use permit
application for the November 9 Planning Commission meeting.
