The tiling of this Bill of Assurance and the Replat of Adams M 2 - 00OX 695 F4GF 41 Addition to the City of " ttle, Rock for record in the office of the Pulaski County Recorder shall be a valid and complete dslivary and dedi- cation of the streets and easements shown on said Replat of Adams Addi- tion to the City of Little Rock. In further consideration of the benefits to accrue to each of the undersigned, which they hereby also acknowledge to be of value, the said undersigned owners have also caused to be filed with the Pulaski County Recorder this Bill of Assurance imposing certain covenants and restrictions upon the property of-med by them, the descriptions of which property are set forth opposite their names in Colwyn 6 hereinbeloa; and accordingly, all property, the owners of whioh have executed this Bill of Assurance together With the Replat of Adams Addition to the City of Little Rock, shall be hereafter subject to the following covenants and restrictions, to-wit- (1) The development and use of land shall conform to all applicable laws, codes, ordinances and regulations which relate to the utilizzti❑n of land. (2) Each duelling unit shall contain no less than a bath- roon plus two habitable rooms (one of which si,all bo a bedroom). The bathroom shall have access -from within the living unit. (3) the ground floor area of any dwelling on any lot covered by this Bill. of Assurance shall not be less than 3L5 square feet. (4) No new residential building shall be constructed on a lot or Iota having a width of less than 37.5 feet at the building line or an area of less than 5,OW square feet. (5) No new building small be constructed on any property nearer to the front property line than 25 feet. No newly constructed building shall be located nearer than 5 feet to an interior lot line, except that side yard shall be a minimum of 3 feet for a garage or other permitted accessory building. The covenants and restrictions set forth hereinabow, are to run with the land and shall bo binding upon all parties hereto and all persons claiming under the parties hereto for a period of twenty (20) years from the date of filing of this Bill of Assurance with the Pulaski County Recorder, and shall autocratically extend for an additional twenty (20) year period unless this Sill of Assurance is amended, cancelled or supplemented in the manner as set forth in the ibllowing paragraph. Said covenants and restrictions shall not be amended, cancellcd, supplemented or extended beyond the terms provided in the preoeding para- graph unless an instrument signed by the ovn-ers of at least sixty porccnt (60%) of the lots affbcted by this Bill of Assurance, if any, {'iced pur- suant to the following paragraph is placed of record with the Pulaski, County Recorder agreeing to amend, cancel., supplep:ent or extend said Cove- nants and restrictions in whole or in part. In the event of any violation or any attempted violation of any of the covenants or restrictions contained herein before the expiration date hereof, it shall be lawful for any person or persons owning a lot or lots subject to the provisions of this Ball of Assurance to prosecute any Proceeding at law or in equity against the person or persons violating or attempting to violate any such covenant or restriction, and either to Prevent such person or persons from so doing or to recover damages for such violation.
