Ellis 5303 West 33rd Street Lot 5, Block 8, Intercity Addition I-2 A variance is requested from the area regulations of Section 36-320 to permit construction of a raised landing and walkway with a reduced side yard setback of 1.8 feet. The Ordinance requires a side yard setback of 15 feet in the I-2 district. Justification: The lot is only 50 feet wide. The existing building has only a 5.8 foot side yard setback. As a part of the renovation of the existing building, the applicant is required to install a fire exit on the side of the structure. The 4 foot wide landing and walkway are to provide a transition from this fire exit to the ground. Present Use of Property: Warehouse Proposed Use of Property: Warehouse and office Staff Report: Engineering Issues: Dedicate Master Street Plan right-of-way of 35 feet from the centerline of Mabelvale Pike. The nature of the minor exterior construction does not warrant in lieu fees for street construction. B. ta£f Anal is The applicant is currently renovating a portion of this existing warehouse building to meet the growth of his business. To comply with fire code requirements, a fire exit must be installed on the side of the existing building. The existing, non -conforming building currently has a 5.8 April 24, 1995 Item 1(Cont.) foot side yard setback. A 15 foot side yard setback is required in the I-2 district. At the point that the fire exit is installed in the side of the building, the applicant proposes to install a landing and walkway. The new structure will be 28 inches above grade and will have hand rails extending above that. The proposed new landing and walkway will come to within 1.8 feet of the side property line. The proposed walkway will extend behind one single family residence and staff feels that screening should be installed along that portion of the property line adjacent to this occupied single family residence. The fire exit, landing and walkway will not serve as a primary access to the building and, as such, will not generate much pedestrian traffic. With attention to screening the adjacent residence, the proposed construction should not have a negative impact on neighboring properties. C. Staff Recommendation: Staff recommends approval of the requested side yard setback variance subject to the following conditions: 1. Compliance with the City Engineer's Comments 2. Screening is to be installed along the property line where the proposed walkway is adjacent to the residence. 3. No portion of the landing or walkway are to be enclosed or covered with a roof. BOARD OF ADJUSTMENT: (APRIL 24, 1995) The applicant, William Ellis, was present. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. Staff informed the Board that a letter had been received from J. T. Jaynes, owner of the adjacent residential property located at 15316 West 34th Street. In his letter, Mr. Jaynes voiced no opposition to the requested variance but he did ask that a minimum 6 foot tall privacy fence be installed along the common property line between his property and Mr. Ellis'. Mr. Ellis offered no additional comments other than to state that he understood staff's recommendation. A motion was made to approve the requested side yard setback variance subject to the following conditions: F, April 24, 1995 Item N 1 C n 1. Compliance with the City Engineer's Comments 2. A 6 foot tall privacy fence is to be installed along the property line where the proposed walkway is adjacent to the residence at 5316 West 34th Street. 3. No portion of the landing or walkway are to be enclosed or covered with a roof. The motion was approved with a vote of 8 ayes, 0 noes and 1 absent. 3
