AN ORDINANCE VACATING AND CLOSING A PORTION OF GLOVER
STREET NORTH OF BISCAYNE DRIVE IN BELLEVUE AND GIBBY
ADDITIONS TO THE CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed wit the Little Rock City Clerk on 30th Day of
November , 2001 asking the Little Rock Board of Directors to vacate and abandon a
portion of Glover Street, North of Biscayne Drive, in Block 20, Bellevue Addition and in
Gibby Addition to the City of Little Rock Arkansas, as designated on the plats of said
Additions now appearing of record in Plat Book 1, page 251, and Plat Book 13, page 67,
in the Office of the Recorder of Pulaski County, Arkansas.
WHEREAS, after due notice as required by law, the Board of Directors has, at the time
and place mentioned in the notice, heard all persons desiring to be heard on the question
and has ascertained that the street hereinbefore described, as been dedicated to the public
use as a street herein described, has been dedicated to the public use as a street, that all
owners of the property abutting upon the portion of the street to be vacated have filed
with the City Clerk, their written consent to the abandonment; and
WHEREAS, the public interest and welfare will not be adversely affected the
abandonment; and
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Except as stated in Section 2 below, the City of Little Rock,
Arkansas, herby releases, vacated and abandons its rights, together with the rights of ,
public generally, in and to the street designated as follows:

Part of the SW /1/4 of the SE /1/4 of Section 26, T -2 -N, R -13 -W, as shown on the Map of
Bellevue Addition to the City of Little Rock, Pulaski County, Arkansas, recorded it $iaf
Book No. 1, page 251, said area formerly known as Fourth Street, now known as Glover' '
Street, more particularly described as follows; Bounded on the East by the West line of
Lot 7 and Lot 6, Block 20 of said Bellevue Addition, said West line extends from the
Southwest comer of said Right of Way line of Biscayne Drive; on the West by an
unplatted property, and also by the East line of Lot No. 1, Gibby Addition to the City of
Little Rock, Arkansas, said Lot having dedicated an Additional 10 feet of street Right of
Way of which now is a part of this abandonment; and on the North by a previously
abandoned section of Glover Street, and abandonment described in Ordinance No.
12,683.
SECTION 2. The City specifically retains the right to use, and allow others to use, a
portion of the former street right of way as a public utility and drainage easement as
follows: The original 30 foot right -of -way along the Western boundary of Block 20,
Bellevue Addition is retained as a public utility and drainage easement. The remaining
10 foot right of way dedication made along the Eastern boundary of Lot 1, Gibby
Addition is to be abandoned with no easement rights retained.
SECTION 3. Abutting owners of record, receiving title to the abandoned right of way
and easement shall at their cost remove all vestiges of public use and access as my exist;
such modifications shall include, but are not limited to the following:
A. The entrances on both ends of the abandoned right of way and easement shall be
offset and/or rebuilt to conform to the standard driveway design as required by
Little Rock, Ark. Code Sec. 30 -26 -50 (1988).
B. The edge of pavement of the right of way shall be rebuilt to conform to existing
conditions in the general vicinity where the abandoned right of way and easement
intersects with the remaining public right of way.
SECTION 4. A copy of this ordinance duly certified by the City clerk, shall be filed in
the office of the Recorder of Pulaski County and recorded in the records of the County.
PASSED: January 2, 2002
SECTION 5. This ordinance shall take effect and be in force from and after its passage
and approval.
