Explain that a portion of a pool and pool house has been constructed in their easement and that  you are seeking variance from the LR Board of Adjustment to allow these structures to remain as constructed. Once you have approval complete the application requesting a variance from code Section 36-11 and provide a letter of intent stating the hardship (existing construction encroaching into the utility easement). The city will be able to support your request once the LRWRA approval is submitted. I was able to review the application when I returned to my office this morning requesting a rear yard setback variance. It appears that the setbacks for an accessory structure (pool and pool house)  are in compliance with the code requirements. Accessory structures  are only required to be set a minimum of 3-feet from the rear or side property line. However, the lower pool and the northeast corner of the pool house cross into an easement labeled as “sewer easement” which will require a variance from Sec. 36-11 to allow the continued encroachment of existing structures into a utility easement. Please verify and provide proof (easement dedication deed, or plat) that the easement shown on the survey is only a sewer easement and not a utility easement. If it is sewer easement, you will only need approval of the Little Rock Water Reclamation Authority. If it is a utility easement then approval will also need to be obtained from the other utility companies. Torrence or Romie can provide you with a complete list and the contact person for each.
