Upon Monte’s return this morning I have discussed the requirement of possible replat of 60 Falstone to indicate the reduced sewer easement. The general consensus is that the replat
will not be necessary. Monte also suggested that the property should be resurveyed and the reduced sewer easement be filed w Pulaski county. Once this is recorded return a copy of the
revised survey to LR Planning and Development to be included with the permit documents.
Also, as we discussed this will eliminate the need for a BOA variance or any other city or commission action.
If this meets you’re approval I will pull the requested BOA variance request from the August agenda.

If I’m correct I don’t believe you will be required to obtain a variance. It appears that by reducing the easement width there will be no structures encroaching into the restricted area.
However, I will need to run this by Monte Moore to verify what he will need to accept the replat of the property, if anything. Monte is out of the office through next week but I will
get with him as soon as he returns.
Also, if there is some unforeseen reason that the variance will still need to be reviewed I will not remove your case from the August docket until I have confirmed no further action
is required.

We have received the approval from LRWW.
I have previously submitted this application in May and I believe I am still on the August agenda.
My preference is for this to be replatted and not have to go through the variance process.
The home owners are trying to move into this home as soon as possible.

You will need to obtain approval from Little Rock Water Reclamation. Explain that a portion of a pool and pool house has been constructed in their easement and that you are seeking
variance from the LR Board of Adjustment to allow these structures to remain as constructed. Once you have approval complete the application requesting a variance from code Section
36-11 and provide a letter of intent stating the hardship (existing construction encroaching into the utility easement). The city will be able to support your request once the LRWRA
approval is submitted.

I understand that you have been in contact with Torrence and Romie in my office concerning you BOA variance for 60 Falstone. I was able to review the application when I returned to my
office this morning requesting a rear yard setback variance. It appears that the setbacks for an accessory structure (pool and pool house) are in compliance with the code requirements.
Accessory structures are only required to be set a minimum of 3-feet from the rear or side property line. However, the lower pool and the northeast corner of the pool house cross into
an easement labeled as “sewer easement” which will require a variance from Sec. 36-11 to allow the continued encroachment of existing structures into a utility easement. Please verify
and provide proof (easement dedication deed, or plat) that the easement shown on the survey is only a sewer easement and not a utility easement. If it is sewer easement, you will only
need approval of the Little Rock Water Reclamation Authority. If it is a utility easement then approval will also need to be obtained from the other utility companies. Torrence or Romie
can provide you with a complete list and the contact person for each. Once all the information is received Torrence or Romie will be able to process your application.
