STAFF COMMENT:
This application was considered by the Planning Commission
on February 23, 1982, and was recommended for denial. The
Board of Directors received an appeal on the application and
upon consideration of the proposal, sent the matter back
to ask the Planning Commission to review the plan and see if
it were willing to change its recommendation.
In the original zoning request, the applicant had refused to
commit to any set development, but at the time the appeal
was forwarded to the Board of Directors, the applicant
submitted a site plan and a proposal for eight units to be
constructed on this site. The Board felt that it would be
appropriate for the Planning Commission to look at the
proposal as it now stands and to offer its recommendation.
In the past application, the staff was supportive of the
proposal and recommended approval of the zoning. The staff
still thinks that this proposal is appropriate for the
neighborhood.
PLANNING COMMISSION ACTION:
Ralph Bozeman, J.M. Collins, and Jimmy Collins were present
as were a number of objectors. The applicant explained
briefly how the matter had returned to the Planning
commission's agenda and offered to provide more information
about the project proposed. The Chairman stated that he
could see no new information which could be provided and
refused to allow the applicant to continue.
Several objectors, including Tonia Cullum, Ralph Megna, and
Skip Tuttle, were permitted to speak and all took to task
the information that the applicant had provided to the Board
of Directors regarding renovation costs of the present
structure, the income presently derived from the property
and the quality of the neighborhood. The Chairman read from
three letters which had been received, all opposing the
project.
After this discussion, the Commission moved to affirm its
recommendation for denial. The motion passed - 10 ayes,
0 noes, 1 absent.

PLANNING CONSIDERATIONS:
No adverse comments have been received from any reviewing
agency regarding this request. There will be neighborhood
opposition to this request. Staff has received some letters
from neighbors, and it appears that neighbors desire to
maintain the status quo on this property. It seems that
neighbors would rather have the existing, somewhat rundown,
building with inadequate parking than to see any new
construction. The applicant has scheduled a neighborhood
meeting, and this may have some nullifying effect on the
opposition.
The applicant proposes to remove the existing structure
which contains four units and replace it with an eight -unit
structure. The existing multifamily use of this property,
the surrounding land uses on three sides, the existing
zoning pattern in the neighborhood and the Heights/Hillcrest
Plan all tend to support this application.
STAFF RECOMMENDATION
Staff recomends approval.

COMMISSION ACTION:
The applicant was present, and there were approximately 10
objectors present. The applicant showed a typical site plan
as proposed for the property and photos of the existing
structure and stated that eight to 12 units were proposed on
the site. He stated that the property had been purchased 36
years ago and that it had reached its economic peak and
would not be feasible for renovation and continued use. He
stated the units proposed would be approximately 270 square
feet in size and have two bedrooms. He indicated that an
expectation of $300 per month rent/per unit was involved in
this project, and he discussed briefly the renovation
questions and tax advantages to putting up a new structure.
The objectors presented several arguments against removal of
the existing structure saying that it would harm the
neighboring properties. They expressed concerns about
access to the property and stated that this was "spot
zoning" at its worst. They presented a petition with 200
signatures in opposition to the zoning and after this
lengthy presentation by the objectors, the Commission moved
to approve the application. The motion failed on a vote of
0 ayes, 9 noes, 1 absent and 1 abstention (Robert Wright
abstained).
