Engineering Issues: Z -3690-A Don Perrymore 1205 North Taylor Lot 8, Block 1, Hollenberg's Addition to the City of Little Rock, Pulaski County, Arkansas R-2 Single Family From the height and area provisions of section 36-156-2.E to permit construction of an accessory structure. The accessory structure is needed to provide protection to the automobiles. Residential Residential There are no engineering issues to report. B. Staff Analysis: The request before the Board is for relief from the Ordinance requirement to allow for the construction of an accessory structure that will serve as a garage. If allowed, this accessory structure will exceed the rear yard coverage provision of 30%. The size of the structure will be 20 X 22 feet. On May 18, 1981, the applicant was granted a variance for a reduced side yard setback for an accessory structure. Since no construction ever happened, the Zoning Enforcement office stopped the applicant from continuing work after a complaint was received. When a variance is granted by the Board, the applicant has two years from the date of approval to obtain a building permit. Residential zoning surrounds the site. Access to the structure will be taken off the alley. 1 rlarch 23, 1992 Item No. 1(Cont.) Staff feels that the applicant's request is reasonable and will not impact the adjacent property owners. However, staff will condition any recommendation of approval with the applicant's understanding that the garage can never be used as an office for his construction business for any reason. C. Staff Recommendation: Staff recommends approval conditioned upon the garage never being used as an office for any reason. BOARD OF ADJUSTMENT ACTION: (MARCH 23, 1992) The applicant was in attendance. There were no objectors present. Staff informed the Board that the notice to the property owners was not -done in the required time frame. A motion was then made to accept the notice. The motion passed by a vote of 8 ayes, 0 noes and 1 absent. The applicant was asked if he had a problem with staff's recommendation. The applicaniz stated that there were no problems. A motion was then made to approve the variance request per staff's recommendation. The motion passed by a vote of 8 ayes, 0 noes and 1 absent. 2
