Neighboring property owners will oppose th,e requested zoning in significant numbers. Staff knows of the existence of a petition which contains at least forty signatures. The Suburban Development Plan calls for this area to be used for industrial development, including all the property east of Mabelvale Pike as well. A commercial refrigeration business is located on the property at the present time, and the proposed zoning would bring the use into conformity with the ordinance. At the request of the Planning Commission, staff has reevaluated this area within the Suburban Development Plan and has determined that the neighbors are essentially correct in that the area seems more appropriate for residential use than the industrial use originally called for in the Suburban Development Plan. As a part of this application and carried as a later item on this agenda, there is a recommendation for a major suburban development plan change which would eliminate all of the industrial zoning shown in and around this tract in favor of a combination of single family and single family attached uses for the vacant properties at this location. This change in May 26, 1981 Item No. 4 - Continued the plan, if adopted by the Planning Commission and subsequently by the Board of Directors, will mean that this application would not be compatible with the plan. STAFF RECOMMENDATION Staff recommends denial of the application on the assumption that the plan change will be approved. COMMISSION ACTION The applicant was present, and there were several objectors. A lengthy discussion involving the proposed plan change dealing with this area on the Suburban Development Plan ensued. Most of the discussion, in fact, revolved around Item 19 on the Agenda, dealing with the plan change. After the Planning Commission voted to recommend to the Board of Directors that the plan be changed so that the property previously shown for Industrial would now be shown as Residential, the Commission moved to approve this application as filed. The motion failed on a vote of 0 ayes 9 noes and 2 absent.
