HomeMy WebLinkAboutZ-3660-B Staff AnalysisDecember 15, 1981 ZONING SEE Z-3721 Item No. 10 - Z3660 -B OWNER: Otter Creek Development Company APPLICANT: Ronnie Hall LOCATION: Southeast Corner of I-30 and Mabelvale West Interchange REQUEST: Rezone from "I-2" Light Industrial to "C-3" General Commercial PURPOSE: Branch Bank SIZE: 0.89 Acres + EXISTING USE: Vacant STAFF COMMENT Subsequent to the legal advertisement being published, which included this zoning request, the application was withdrawn by the applicant. The proposed branch bank will be located elsewhere. Staff recommends withdrawal. COMMISSION ACTION: The applicant stated that after his letter was sent to the Planning Division, asking that this case be withdrawn, a decision was made that it was appropriate to follow through with the zoning request by the bank officials. Staff briefly filled in the Planning Commission on the activities surrounding this case, stating that the property on the north side of Interstate #30, originally planned for this branch bank, would not be approved because of its involvement with the proposed changes to the Interstate #30 Interchange for the Otter Creek Mall. Staff suggested that, if the Planning Commission chose to approve this application, that it also would recommend to the Board that the previous zoning application be rescinded such as Case Z-3721, which was approved on September 1, 1981 by Ordinance No. 14,103. The Commission, after the discussion, moved to approve this application with two conditions: (1) The transfer of the original agreement by Worthen Bank that the City would in no way incur any liability relative to the relocation of the branch bank at the time of road construction and, (2) That the action taken in Case Z-3721 be rescinded through appropriate action by the Board of Directors. The applicant agreed to both conditions and the motion was passed: 10 ayes, 0 noes and 1 absent.
