From the area regulations and height regulations of Section 36-302 to permit construction of a 45 foot tall parking deck with a reduced side yard setback of 3 feet. justification: Applicant's Statement "We are requesting a zoning variance for the height restriction on our parking deck project. Our parking deck will be 34 feet in height. We are required to have two stairwells and we would like to enclose these stairwells to prevent them from being subject to the weather elements particularly freezing rain. This would add an additional 9 feet to the project. We are, therefore, asking for a variance extending the height restriction to 45 feet. We are also requesting a variance on the setback requirement on the west side of our property. The parking deck will be 180 feet across the front and has to be constructed in 60 foot increments. We need to put our deck on the west side property line in order to have sufficient room for a fire lane on the east side as shown on the plans which is required. Parking at the Little Rock Airport at this time is in short supply on October -30,.1995 Item No. 3 (Cont.=„) Present Use of Pr9perty: Proposed Use gf_Property: Staff Report: A. Additional Traffic Engineering Comments related to the driveway entering the parking deck from Roosevelt Road are as follow: 1. Move the driveway to a point 100 feet west of the existing driveway. The proposed driveway entering the parking deck is too close to the existing driveway. 2. Widen the proposed driveway entering the parking deck from Roosevelt Road to accommodate two lanes in and two lanes out. B. S aff Analysis: Security Airport Parking, Inc. proposes to construct a 4 story parking deck on the property located at 4405 East Roosevelt Road. The property is currently zoned C-3. A C-4 rezoning request was approved by the Planning Commission on October 3, 1995 and will be heard by the Board of Directors on November 7, 1995. This application was taken on the assumption that the site would be zoned C-4 since the parking deck would not be allowed without the rezoning being approved. The proposed parking deck will have a total height of 45 feet and will have a side yard setback on the west side of 3 feet. The C-4 district has a height restriction of 35 feet and requires a side yard setback of 15 feet. The top floor of the deck structure feet tall. This proposed height does not appear to be out of character with other uses in the vicinity. The Wilson Inn, adjacent to the west, is a 5 story hotel with a height of 55 feet. As long as the property was zoned C-3, it had no side yard setback requirement. Once it is zoned to C-4, a fifteen foot side yard is required. The applicant proposes a three foot side yard setback on the west side. The adjacent property, to the west, is occupied by the Wilson Inn. Two rows of parking, a driveway and a landscaped strip provide a separation of approximately 70 feet between the hotel and the property line shared with the applicant. It would appear that the reduced side yard should have no impact on the adjacent property. Due to the site's relationship to the Little Rock National Airport, approval must be granted by the FAA, through the Airport Commission staff. C. 5Laff R c mm nd ion: Staff recommends approval of the requested setback and height variances subject the following conditions: 1. Compliance with the Engineering Comments 2. Compliance with the City's Landscape and Buffer Ordinances 3. FAA approval must be granted prior to a building permit being issued for the structure. BOARD OF ADJUSTMENT: (OCTOBER 30, 1995) J. Dan Baker was present representing the application. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. The Board was informed that the applicant had agreed to relocate the driveway to the west and to redesign the driveway, providing two lanes in and one lane out of the parking deck. That arrangement had been agreed to by the City Traffic Engineer's Office. Mr. Baker stated that he agreed with staff's recommendation. A motion was made to approve the requested height and setback variances subject to the following conditions: 1. The driveway is to be moved 100 feet to the west of the existing driveway. 2. The driveway entering the deck from Roosevelt Road is to have two lanes entering and one lane exiting. 3 October •30, . 1995 Item No_ (Cont.) 3. The motion was approved by a vote of 7 ayes, 0 noes, 1 absent and 1 open position. 4
