McKinley Lloyd McKinley 5415 "C" Street Rezone from "R-3" Single Family to "R-4" Two Family Construction of Duplex 6,625 Square Feet + Vacant SURROUNDING LAND USE AND ZONING North - Single Family, Zoned "R-3" South - Single Family, Zoned "R-4" East - Single Family, Zoned "R-3" West - Single Family, Zoned "R-3" PLANNING CONSIDERATIONS No adverse comments have been received from any reviewing agency. A few neighbors have expressed concern about the proposed zoning and are expected to appear at the meeting in protest. The Heights/Hillcrest Plan being proposed for this area shows the future land use as approximately the same as the existing zoning in the area. There are scattered duplexes in the area some of which are properly zoned and others not. Staff essentially supports the in -fill of duplex construction on this lot feeling that it would not produce ill effects on the neighborhood, but we are reluctant to support the "R-4" zoning requested. The existing "R-3" zoning will permit such duplex construction as a conditional use. STAFF RECOMMENDATION Staff recommends that this application be converted to a request for a conditional use permit for the duplex. This would necessitate that the applicant submit a site plan showing the proposed location of the new structure for consideration by the Planning Commission. This can be accomplished in a timely manner and should produce no undue hardship on the applicant. December 9, 1980 Item No. 15 - Continued COMMISSION ACTION The applicant was present and there were several objectors. The applicant discussed the plans for the duplex stating that it would be of all brick construction and presented a site plan of the proposed development. The opponents, represented by Mrs. Holmer Morehart of 5409 "C" Street, presented a petition with 17 signatures and stated that 7 opponents were present. Their opposition to the request centered around parkinq problems in the area, what they perceived as safety issues for children and the potential for devaluation of the property if the duplex were to be constructed on this property. The applicant agreed to amend the request to a conditional use permit rather than seek the rezoning to "R-4." The Planning Commission reviewed his site plan which showed that the proposed development would meet all setback requirements required for a duplex and would provide the required parking. In fact, the design showed four parking spaces wherein the ordinance would require only three. After this discussion and review, the Commission moved to approve the conditional use permit to permit a duplex on this property. The motion was passed: 7 ayes, 2 noes, 2 absent.
