Central High LOD [IWOV-iManage_docs.FID30789] Sounds good. I knew you’d have a good answer! Do let me know what y’all decide. It’s not really a legal issue, just something for you Planning people to hash out. –Sherri From: Ratzlaff, Hannah K. <hratzlaff@littlerock.gov> Sent: Monday, July 25, 2022 4:47 PM To: Latimer, Sherri <slatimer@littlerock.gov> Cc: '4022_047 _ Planning _ Central High Neighborhood Historical District _E_mail' <{F30789}.iManage_docs@ca- indexer.littlerock.state.ar.us> Subject: RE: Ord. Central High LOD [IWOV-iManage_docs.FID30789] Thanks Sherri! That makes more sense that it is several ordinances. Very confusing. I believe the guidelines and the DOD can coexist in principle, depending on the regulations of the future Central design guidelines. My understanding is that the HDC guidelines would supersede the DOD but could not ignore it. I don’t think they would be contradictory. If the LOD passes, we will need to hire a consultant to construct guidelines specific to Central. Until then, we can use the MacArthur Guidelines. It’s likely the Central LOD guidelines will be more restrictive that the DOD. Additionally, there is a large section of the DOD that is not within the Central LOD boundaries. About 14 blocks to the west of the high school. I don’t think we would want to lose the DOD standards there. This question is on Jamie’s list to discuss with me this week. I’ll get back to you on what we are looking at! Thanks, Hannah Ratzlaff Urban Designer & Historic District Commission Staff Planning & Development, 723 W. Central High LOD [IWOV-iManage_docs.FID30789] No worries. Ch. 23, Art. IV is actually several ordinances, none of which addresses a Central High Historic District since it doesn’t exist yet. I’ll draft the ordinances and let you review them. But this discussion has made me wonder if the LOD will in any way conflict w/ the overlay district. I don’t think there’s any legal reason they both can’t exist, but will the 2 overlay district (LR Code § 36-434.25, et seq.) conflict with the HDC Guidelines that will apply to the area once it becomes a historic district? (Here’s where I need some hand holding!) I don’t think so but I’d have to read the relevant Code sections carefully. Any thoughts? Central High LOD [IWOV-iManage_docs.FID30789] Yes, the Historic Preservation ordinance already exists. It is Chapter 23. Article IV. of the code of ordinances. Ah, I understand. Yes, this is all new to me and I will need some hand holding. Since provisions for the HDC are within this ordinance, would they require two separate Board approvals? Central High LOD [IWOV-iManage_docs.FID30789] Hannah, I’m afraid I don’t know what you mean by a “Historic Preservation ordinance.” What section is it? There’s a design overlay district but that’s a separate thing. Will it be affected by the LOD? Is that what you’re asking? Please clarify. (The short term rental ordinance is drafted that way because it’s amending an ordinance which already exists.) And we don’t have the authority to codify the ordinance which is what you sent. After the Board passes an ordinance, the Clerk does something with it and it gets codified in the official City code (available through Municode). We’ll have to draft 3 ordinances for Board approval: (1) for the district, (2) to enlarge the HDC, and (3) to amend Section 23-100. I can draft these documents if you want when the time comes. Central High LOD Sherri, Since we already have a Historic Preservation ordinance, should the ordinance to establish a Local Ordinance District for the Central High Neighborhood Historic District show proposed changes to the existing ordinance (proposed changes to ordinance attached)? Similar to how the ordinance for Short-Term Rentals is being proposed (example attached). Thanks, Hannah Ratzlaff Urban Designer & Historic District Commission Staff Planning & Development, 723 W.
