C-4 district.
Justification: As part of an effort to remodel and
modernize the existing service
station, the applicant wishes to
add a small convenience store, two
more auto service bays and a larger
and longer canopy over the fuel
islands. The setback variances are
necessary due to the size and
configuration of the lot and the
design of the existing service
station.

Staff Report:
A. Engineering Issues:
Repair the sidewalk on the north side of the east driveway.
Replace and correct the slope of the sidewalk on the south
side of the east driveway. Resubmit and correct the
handicap ramps at the intersection. Compliance with the
City's Stormwater Detention Ordinance is required. The
driveway on the east side is damaged and needs to be
replaced. The flood hazard data submitted is outdated and
incorrect.
B. Staff_ Analysis:
As part of a project to remodel and modernize this existing
service station, the applicant wishes to add a small
convenience store, two more auto service bays and a larger
and longer fuel island canopy. Two existing, portable
buildings/trailers will be removed from the site.
The proposed service bay addition is to be built with a side
yard setback of 5 feet. A fifteen foot side yard setback is
required in the C-4 zone. The property has a side yard
relationship wit the Colony West shopping Center property,
which is zoned C-3. The proposed service bay addition is
designed so the corner of the addition intrudes into the
side yard setback. Only a relatively small portion of the
proposed addition is actually located within the required
side yard. Staff feels that the request is reasonable and
supports the side yard setback variance.
The service station has an existing fuel island canopy which
crosses the 40 foot building line and which has a front yard
setback of 23 feet. The proposed new canopy will be
approximately 5 feet wider and will have a front yard
setback of 13 feet. The C-4 district requires a front yard
setback of 45 feet. The new canopy is designed so that the
supports are located at the fuel islands and the canopy
extends beyond, with no additional ground -mounted supports.
This allows for adequate movement of light and air. The
canopy will have a setback from the traffic lanes on Rodney
Parham of approximately 27 feet. Staff feels that the
proposal is reasonable and supports the building line
variance. I
If the building line variance is approved, the applicant
should file a one lot replat and an amended Bill of
Assurance.

C. Staff Recommendation:
Staff recommends approval of the requested side yard setback
and building line variances subject to:
1. Compliance with the City Engineer's Comments
2. The existing, portable buildings/trailers being removed
from the property.
BOARD OF ADJUSTMENT: (JANUARY 30, 1995)
The applicant, Ronald Keltner, was present. There were no
objectors present. Staff presented the item and a recommendation
of approval subject to compliance with the City Engineer's
Comments and the existing, portable buildings/trailers being
removed from the property.
Mr. Keltner offered no additional comments.
A motion was made to approve the requested side yard setback and
building line variances subject to compliance with those
conditions outlined in the staff recommendation. The motion was
approved by a vote of 6 ayes, 0 noes, 2 absent and 1 open
position.
