Present Use of Property: Vacant Proposed Use of Property: Duplex Staff Recommendation: Section 5-101 of the Zoning Ordinance provides the basis for this request. The "continuance" provisions allowing usage of lots made nonconforming by the ordinance, and a separate section, labeled "nonconforming lots," provides that those nonconforming lots have grounds to seek a variance from setback provisions when they have been made nonconforming by the ordinance. Proposed side yard setbacks are 5 feet, which would have been normal for a single family dwelling on this lot. The ordinance requires 8 -foot side yards in a duplex district. Staff recommends approval of the variance.
