NEED OR DEMAND The applicant states the intention of constructing a walk-up sandwich shop at this location. 2. COMPATIBILITY WITH MUNICIPAL PLANS The property lies within the Central Little Rock CDBG Planning Area; however, work on this plan has not yet begun. The only commercial use nearby is the "Mom and Pop" store immediately to the north of the site. It is zoned 11C-3" and probably achieved that zoning back in the days when the governing body did zoning by resolution. Staff does not view this existing use and zoning to provide any special efficacy to this request. 3. EFFECT ON ENVIRONS No particular adverse environmental impacts would be expected from this request. 4. NEIGHBORHOOD POSITION Very little neighborhood comment has been heard; however, one or two residents have voiced opposition. 5. PUBLIC SERVICES No adverse comments have been received. 6. UTILITIES/EFFECT ON No adverse comments have been received. 7: EFFECT ON PUBLIC FINANCES None expected. 8. LEGAL/REASONABLE In the staff's opinion, the request constitutes "spot zoning." As stated earlier, the existence of the other "C-3" District and use to the north does not provide sufficient basis for this particular zoning request. September 30, 1980 Item 9 - Continued 9. STANDARDS OF QUALITY No standards have been addressed. 10. TRAFFIC AND RIGHT-OF-WAY There are no right-of-way issues, and a walk-up facility as proposed would not produce any particular traffic problem. ANALYSIS: In staff's view, this request is without merit for the reasons stated above. In addition, the City's Department of Human Resources has stated its opposition to this zoning request. STAFF RECOMMENDATION: Staff recommends denial. COMMISSION ACTION: The applicant was present and described the proposed operation of the walk-up sandwich shop and argued for approval of the zoning requested. There were eleven opponents present. Several of those opponents stated their opposition, and after a lengthy discussion, the Commission moved to approve the application as filed. The motion failed - 0 ayes, 9 noes and 2 absent. The application was declared to have been denied.
