The applicant was denied "MF -18" zoning on this same property about one year ago. At that time, significant opposition was expressed by the residents of Brownwood Terrace Subdivision, which lies north of this property. No neighborhood opposition has been expressed so far regarding this new application. Staff opposed the previous request, citing the existence of several vacant properties zoned for apartments in the nearby area. Nothing has changed in this regard. This property is shown for single family development on the Boyle Park Plan, which is due for adoption soon. There appears to be little demand for apartment land in this area, and this request seems inappropriate at this time. STAFF RECOMMENDATION Staff recommends denial. June 30, 1981 Item No. 2 - Continued COMMISSION ACTION The applicant was present, and there were approximately thirty objectors present. The applicant made a brief presentation, citing the historical perspective on this property, certain of the neighborhood issues, new developments relative to other properties within the area and discussed briefly with the Planning Commission factors relating to development costs associated with single family development of the property vis-a-vis the more intense development alternatives. Roland Carpenter, 8705 Labette Drive, president of the Brownwood Terrace Homeowners Association, introduced Emma Rhodes, of 8621 Labette Drive, who presented a petition containing 74 signatures citing the opposition of the neighborhood to the zoning request. Some of the factors cited were that there were still a number of properties zoned for multifamily use, but as to now undeveloped, indicating a lack of demand for multifamily development in the area, devaluation of their single family properties which they see as associated with multifamily uses nearby, crime expected to increase as a result of the intense development of the area, and traffic associated with the development of this area for multifamily use. Mr. Carpenter then stated, speaking for the Homeowners Association, that they would be willing to discuss with the applicant a compromise which might achieve a development potential with which both parties could agree. The applicant and the home owners agreed to defer the matter to the July 28 Planning Commission meeting. The Commission moved to defer the matter, and the motion was passed: 9'ayes, 0 noes and 2 absent.
