Dobbins Address: 6319 Forbing Road Description: Long Legal Zoned: "I-2" Light Industrial Variance: (1) From Section 5-101-C-1 to permit expansion of a nonconforming use. (2) From Section 7-104.2C to permit expansion of a nonconforming use. (3) From Section 7-104.2E to permit expansion of a nonconforming structure. Present Use of Property: Single Family Residential and Industrial Proposed Use of Property: Same Staff Recommendation: This request deals with a true "cottage" industry. The owners of the Jordan Mattress Company also have their family home on the same property with the business, and they have found that it is necessary to enlarge the home for family comfort. Under the new Zoning Ordinance, single family dwellings are not permitted within the "I-2" Light Industrial District. There is no doubt that under normal circumstances single family dwellings should not be encouraged in industrial locations. However, it is staff opinion that this case constitutes a new unique circumstance. While the ordinance specifically prohibits the Board of Adjustment from permitting a use which is not allowed within a district, the ordinance is somewhat silent on the treatment of existing prohibited uses, except in dealing with them as nonconforming uses. A City Attorney's opinion given several months ago indicates that the Board of Adjustment appears to be in power to deal with any aspect of the ordinance with regard to variances. Staff recommends approval of the variances.
