FACTUAL INFORMATION

1. NEED OR DEMAND
The owner seeks this change in recognition of a modification
of development plans within the St. Charles Subdivision.
More land has been acquired which can be incorporated into
this development, and another "MF -12" District to the east
is proposed for downzoning to "R-2."
2. EFFECT ON MUNICIPAL PLANS
The proposal would appear to be compatible with municipal
plans and the development scheme established for this
project.
3. EFFECT ON ENVIRONS
No adverse environmental impacts are expected.
4. NEIGHBORHOOD POSITION
A few neighboring owners have expressed an interest in this
proposal, but staff cannot judge the position of the
neighbors based upon these contacts.
5. PUBLIC SERVICES
No adverse comments have been received.
6. UTILITIES
No adverse comments have been received.
7. PUBLIC FINANCES
No fiscal impact is expected.
8. LEGAL/REASONABLE
A slight upward shift in density at this location seems
appropriate because of its relationship -to two collector
streets, particularly with the downward shift at the eastern
location.
9. STANDARDS OF QUALITY
No standards of quality have been addressed.

10. TRAFFIC AND RIGHT-OF-WAY
St. Charles Boulevard and Parkway Place Drive are collector
streets on the Master Street Plan. Both will be constructed
at the time of development and the rights-of-way will be
acquired through platting.
AMAT.v-QTS:
Staff believes that the proposed changes in the zoning pattern
within St. Charles Subdivsion are appropriate.
STAFF RECOMMENDATION:
Staff recommends approval.
COMMISSION ACTION:
The applicant was present, and there were no objectors. One
neighbor was present who asked several questions regarding the
proposed rezoning. The question came up from the Planning
Commission relative to the proposal by the Bailey Corporation to
downzone the property previously zoned "MF -12" to the east of
this property, and there was a motion to defer to August 26. The
motion failed on a vote of 2 ayes, 5 noes, 3 absent and 1
abstention. (Ron Tabor abstained.) A second motion to approve
the application, conditioned upon the filing of an application to
downzone the eastern property was made. That motion failed --
5 ayes, 2 noes, 3 absent and 1 abstention. (Ron Tabor
abstained.) The matter was automatically deferred to August 26.
