1. NEED OR DEMAND
The owner desires zoning which would make his existing use
conforming.
2. EFFECT ON MUNICIPAL PLANS
The Suburban Development Plan shows this area as remaining
predominately agricultural through the year 2000.
3. EFFECT ON ENVIRONS
No adverse environmental impacts are expected.
4. NEIGHBORHOOD POSITION
Staff would anticipate adverse comments from at least one
neighboring owner.
5. PUBLIC SERVICES
No adverse comments have been received.
6. UTILITIES
No adverse comments have been received.
7. PUBLIC FINANCES
No fiscal impact is expected.
8. LEGAL/REASONABLE
While the particular use is common in this part of the City,
the requested zoning would clearly be "spot zoning."
9. STANDARDS OF QUALITY
No standards of quality have been addressed.

10. TRAFFIC AND RIGHT-OF-WAY
Highway 10 is a major arterial on the Master Street Plan.
Additional right-of-way will be required.

Staff erred when this application was made in not remembering
that plant nurseries are permitted in the "AF" Agriculture and
Forestry District. Staff believes, and the applicant concurs,
that the "AF" classification is more appropriate for this use in
this location.
STAFF RECOMMENDATION:
Staff recommends that the property be zoned "AF" Agriculture and
Forestry.
COMMISSION ACTION:
The applicant was present, as were his attorney and architect.
There were eight other neighboring residents present who stated
that they favored the application and two residents of the area
present who could be listed as opponents. A lengthy discussion
developed over whether or not the various provisions of the "AF"
Agriculture and Forestry District ensued over which of the
various provisions of that District would control over this
application, and because of the various opinions and potential
conflicts, the Commission moved to defer further consideration of
the application to the August 26 Planning Commission meeting.
The motion was passed - 8 ayes, 0 noes and 3 absent.
