Variance: (1) Variance from the setback provisions of Section 7-104.3, Paragraph D, to permit a front yard encroachment of 23 feet and a side yard encroachment of 10 feet (2) Variance from Section 8-101 to reduce parking requirements by nine spaces. Present Use of Property: Vacant Proposed Use of Property: Warehouse Staff Recommendation: The hardship involved with this case is the fact that all of the planning which went into the building proposed for construction was accomplished prior to the adoption of the. new Zoning Ordinance. Site selection, building plans and the beginnings of financial arrangements were initiated when the property was zoned "K" Heavy Industrial, wherein no yards were required by Ordinance. The east and south yards do not require variances because of there relationships to existing rail facilities. The north and west yards would be required to have yards of 50 and 30 feet respectively. Parking requirements under the new Ordinance are more demanding as well. Staff recommends approval of both' requested variances. Board Action: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion was passed: 6 ayes, 0 noes and 1 absent.
